Amending regulations on child safety equipment in cars: Excluding passenger transport vehicles

After receiving comments from National Assembly deputies, the Government amended Clause 3, Article 10 of the Law on Road Traffic Order and Safety to regulate the use of safety equipment for children under 10 years old and under 1.35 meters tall when sitting in a car.

Regarding Clause 3, Article 10 of the Law on Road Traffic Order and Safety, which stipulates the use of safety equipment for children under 10 years old and under 1.35 meters tall when sitting in a car, in the draft Law amending and supplementing a number of articles of 10 laws related to security and order being submitted by the Government to the National Assembly at the 10th Session on the afternoon of December 2, the Traffic Police Department ( Ministry of Public Security ) said that after receiving comments from National Assembly deputies, the Government has amended in the direction: "When transporting children under 10 years old and under 1.35 meters tall in a car, children must not sit in the same row of seats as the driver, except for cars with only one row of seats; the driver must use and instruct on the use of appropriate safety equipment for children, except for cars used for passenger transport business".

Thus, the above regulation will exempt passenger transport vehicles from having to use appropriate safety equipment for children, to ensure feasibility and to be suitable for practical traffic conditions in Vietnam.

According to the Traffic Police Department, child safety devices as prescribed are devices capable of ensuring the safety of children in a sitting or lying position in a car, designed to reduce the risk of injury to the user in the event of a collision or sudden deceleration of the car by limiting the movement of the child's body, including: seat systems, cradles, booster cushions... with seat belts to secure children and devices attached to the car.

The Government proposed to promulgate a Law amending and supplementing a number of articles of 10 laws related to security and order to comply with the results of the reorganization of the apparatus, two-level local government and the policy of breakthrough development in science , technology, innovation, and digital transformation.

General Luong Tam Quang, Minister of Public Security, said that the draft Law amends and supplements a number of articles of the following laws: Law on Security Guards, Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, Law on Exit and Entry of Vietnamese Citizens, Law on Residence, Law on Identification Cards, Law on Forces Participating in Protecting Security and Order at the Grassroots Level, Law on Road Traffic Order and Safety, Law on Roads, Law on Management and Use of Weapons, Explosives and Supporting Tools, Law on Fire Prevention, Fire Fighting and Rescue.

The draft law consists of 12 articles, of which 136/570 articles are amended and supplemented and 2 new articles are added to 10 laws related to security and order.
