Kinhtedothi - On the morning of November 1st, at the 8th session of the National Assembly , on behalf of the Standing Committee of the National Assembly, the Chairman of the National Assembly's Committee on National Defense and Security, Le Tan Toi, presented a report explaining, receiving feedback, and revising the Draft Law on Fire Prevention, Fighting, and Rescue (PCCC and CNCH).
Chairman of the National Defense and Security Committee Le Tan Toi said that, in response to the opinions of National Assembly deputies, the Standing Committee of the National Assembly has directed the thorough review and incorporation of the draft law's content in accordance with current legal regulations; and to research, supplement, and refine the draft law to ensure comprehensiveness and compatibility between the scope of regulation and the content of the draft law.

Regarding rescue operations assigned to the military, specific regulations are stipulated in relevant legal documents such as the Law on Civil Defense and the Law on Disaster Prevention and Control. The rescue operations regulated by these laws only cover situations such as fires and everyday accidents and incidents that do not warrant the application of civil defense or disaster risk levels as prescribed by relevant laws, and are assigned to the Fire Prevention and Rescue Force in coordination with other relevant forces.
Regarding fire prevention and rescue responsibilities, the Draft Law has added and clearly defined the responsibilities of each entity involved in fire prevention and rescue activities, including: the responsibility of the head of the facility; the owner of the vehicle; the investment decision-maker, the investor, the vehicle owner, agencies, organizations, and individuals involved in construction, production, assembly, shipbuilding, and modification of vehicles; the head of the household, individuals, and those renting, borrowing, or residing in housing, as specifically stated in the corresponding clauses of Article 7 of the Draft Law that has been revised and amended.

Regarding fire prevention, the draft law has separated Article 17 on fire prevention for residential buildings into two articles: one on fire prevention for residential buildings (Article 19) and one on fire prevention for residential buildings combined with production and business activities (Article 20).
At the same time, the Draft Law has classified and supplemented regulations more fully and appropriately for these two types; fully supplemented regulations on fire prevention for establishments in Article 22 of the Draft Law; and incorporated and revised regulations on ensuring fire safety in the installation and use of electricity for living and production purposes to ensure feasibility and avoid overlapping with current legal regulations.
Regarding regulations on fire prevention and fighting services, the Chairman of the National Defense and Security Committee, Le Tan Toi, stated that the National Assembly Standing Committee agreed with the above opinions that it is necessary to implement the Party's policy of "promoting the socialization of fire prevention and fighting work"; creating more favorable conditions for establishments and businesses in consulting, designing, constructing, manufacturing, importing, and trading fire prevention and fighting equipment and vehicles; and encouraging individuals and organizations to participate in fire prevention and fighting and rescue activities.

Therefore, in order to incorporate the opinions of National Assembly deputies and create uniformity in the legal system, the Standing Committee of the National Assembly directed the removal of the provision that fire prevention and fighting services are a conditional investment and business sector from this Draft Law; at the same time, it proposed amending the Investment Law No. 61/2020/QH14 to remove this provision in item 11 of Appendix IV of the Investment Law.
In addition, the draft law has incorporated, revised, and supplemented regulations on financial sources, ensuring conditions for fire prevention and rescue activities, redesigned the transitional provisions; and separated a provision on handling facilities and structures that do not meet fire safety requirements but were put into use before the effective date of this law…
