'Residency and specialty degrees are not master's or doctoral degrees'

In the latest draft of the Law on Higher Education (amended), the training program for residency and specialist degrees will be managed by the Ministry of Health.

On the morning of December 4, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law on Higher Education (amended).

According to the Government's report, some opinions of National Assembly deputies proposed to supplement regulations to strengthen the responsibility of the Ministry of Health in state management of postgraduate training in specialized and specialized fields in the field of health sciences; and proposed to transfer all management work of the health sector to the management authority of the Ministry of Health.

Along with that is to strengthen the responsibility of the health sector in inspecting and supervising health science training programs at non-medical training facilities.

The Government said that the issue of state management of specialized and advanced postgraduate training in the field of health sciences has been clearly codified up to now.

" The draft Law on Higher Education continues to maintain the principle of unified state management of the national education system of the Ministry of Education and Training, while clearly defining the responsibility of coordinating the responsibility of the Ministry of Health in managing the training of resident physicians and specialists with relevant ministries and branches, including the Ministry of Health in managing the profession, to ensure management of expertise, professional standards and supervision of training activities of health science programs ," the report stated.

According to the Government, this mechanism is designed to both ensure the unity of the university education system and create conditions for specialized ministries and branches to perform the function of managing specialized quality, professional standards, and inspecting and supervising specific training programs.

Up to now, the Ministry of Health has been responsible for inspecting and monitoring the quality of training in medical and pharmaceutical specialties through the issuance of standards, professional guidelines and participation in the appraisal of related programs (training of medical specialists and residents). The current draft Law still maintains this coordination mechanism, both ensuring feasibility and avoiding overlapping powers between state agencies.

Maintaining the management coordination mechanism instead of transferring the entire health sector to the Ministry of Health also aims to ensure the systematic nature of national education, while maintaining the principle: the Ministry of Education and Training manages the State as a whole through regulations, while specialized ministries and sectors carry out management according to their specialized scope and professional standards.

" This approach is consistent with international practices in university education management in the medical and pharmaceutical fields and ensures feasibility in practical implementation ," the Government stated its view.

Incorporating the opinions of delegates, the draft Law on Higher Education (amended) supplements regulations on specialized and advanced postgraduate training in the health field in the direction of "Advanced postgraduate training programs in the health field granting degrees of resident physician and specialist physician managed by the Ministry of Health ".

This regulation ensures the full institutionalization of Resolution 72, ensuring the management role of the Ministry of Health in specialized training programs in the field of health sciences, training of resident doctors, level I and II specialists working in hospitals. At the same time, it is the basis for developing guiding documents under the Law and appropriate remuneration for resident doctors and specialists.

"Thus, the draft Law has fully stipulated the combined management mechanism, clearly stipulating the legal corridor for the Ministry of Health to develop regulatory documents to ensure and improve the training quality of specialized specialized training programs while still maintaining the unified management of the Ministry of Education and Training, ensuring systematicity, expertise and feasibility in implementation ," according to the Government's report.

The Government report also stated that the degrees of the residency, specialist I, and specialist II programs are not master's or doctoral degrees. These are specialized degrees related to specific medical professions, certifying professional competence managed by the Ministry of Health.

Contents related to study conditions, competency standards, training programs, assessment and granting of specialized degrees will be specified in detail by the Ministry of Health in sub-law documents, ensuring feasibility, quality training, and suitability to the specific characteristics of the health sector.

The Ministry of Health is responsible for the professional content, competency standards and practice conditions of specialized postgraduate training programs. The Ministry of Education and Training implements unified management of the system of qualifications, university, master's and doctoral degrees and quality standards in higher education.
