Accordingly, the authority to decide on receiving, adjusting the level of receiving, ceasing to receive monthly social allowances, and supporting monthly care and nurturing expenses for social protection beneficiaries prescribed in Decree 20/2021/ND-CP is exercised by the Chairman of the People's Committee at the commune level.
The order and procedures are as follows:
(1) Subjects requesting monthly social allowances and monthly financial support for care and upbringing with documents as prescribed in Article 7 of Decree 20/2021 shall submit directly or via postal organization or online to the Chairman of the People's Committee of the commune where they reside;
(2) Within 10 working days from the date of receiving the request of the subject, the Chairman of the Commune People's Committee shall organize the review, verification and standardization of the subject's relevant information with the National Population Database, decide and implement monthly social allowance payment, support monthly care and nurturing expenses for the subject. The period of enjoyment is from the month the Chairman of the Commune People's Committee signs the decision;
In case the subject is not eligible for benefits or adjustments, the Chairman of the Commune People's Committee shall respond in writing, stating the reasons;
(3) In case a subject receiving monthly social allowances and monthly financial support for care and nurturing changes his/her place of residence and requests to receive policies at his/her new place of residence, the Chairman of the People's Committee of the commune where he/she previously resides shall decide to stop paying policies and regimes in the locality and send a document with the subject's relevant documents to the Chairman of the People's Committee of the commune where he/she newly resides;
The Chairman of the People's Committee of the new commune of residence shall, based on the relevant documents of the subject, decide on monthly social allowance and monthly care cost support at the corresponding level applied in the locality from the month of cessation of payment at the old place of residence;
(4) In case a recipient of social allowance or monthly financial support for care and nurturing dies, is no longer eligible for benefits or has his/her eligibility changed, the Chairman of the Commune People's Committee shall consider and decide to stop receiving benefits or adjust the benefit level. The time for stopping or adjusting the benefit level shall be from the month immediately following the month in which the recipient dies, is no longer eligible for benefits or has his/her eligibility changed;
(5) For beneficiaries of social allowances and monthly financial support for care and nurturing decided by the People's Committee of the district, town or city before July 1, 2025, the Chairman of the People's Committee at the commune level shall receive the handover documents of the People's Committee of the district, town or city and continue to pay policies to the beneficiaries according to regulations.
In case the subject has submitted an application for social allowance and monthly financial support for care and nurturing before July 1, 2025 but has not yet received a decision on social allowance and monthly financial support for care and nurturing, the Chairman of the Commune People's Committee shall, based on the subject's records and documents, carry out the procedures for deciding on social allowance and monthly financial support for care and nurturing for the subject according to the provisions in section (2). The subject does not have to redo the documents specified in section (1).
Decree 147/2025/ND-CP takes effect from July 1, 2025.
