Prime Minister requests to remove difficulties and obstacles in land valuation

The telegram sent to the Minister of Natural Resources and Environment ; Chairmen of People's Committees of provinces and centrally-run cities clearly stated:

The Government issued Resolution No. 73/NQ-CP dated May 6, 2023, stating that the People's Committees of provinces and centrally run cities, based on the provisions of the Law on Organization of Local Government, Conclusion No. 14-KL/TW dated September 22, 2021 of the Politburo and the actual situation of the locality, shall authorize the People's Committees at the district level to decide on specific land prices. The Government Standing Committee and the Prime Minister have also issued many documents directing the removal of difficulties and obstacles in land valuation (Notice No. 244/TB-VPCP dated June 26, 2023, Official Dispatch No. 469/CD-TTg dated May 25, 2023, Official Dispatch No. 4411/VPCP-NN dated June 14, 2023 and No. 4923/VPCP-NN dated July 4, 2023).

However, according to recommendations from many localities, land valuation in some places still faces many difficulties and problems regarding authority, procedures, and processes, leading to very slow land valuation, affecting the progress of investment project implementation. In order to promptly resolve local difficulties in determining specific land prices, the Prime Minister continues to request:

Minister of Natural Resources and Environment urgently:

Complete before July 31, 2023 the amendment and supplementation of Circular No. 36/2014/TT-BTNMT dated June 30, 2014 detailing land valuation methods, construction and adjustment of land price lists, specific land valuation and land price determination consultancy.

Before July 31, 2023, submit to the Government for consideration and promulgation a Decree amending and supplementing Decree No. 44/2014/ND-CP dated May 15, 2014 regulating land prices as directed by the Government Standing Committee and the Prime Minister in Notice No. 244/TB-VPCP dated June 26, 2023, Official Dispatch No. 469/CD-TTg dated May 25, 2023, in the direction of simplifying procedures, promoting decentralization, delegation of authority, enhancing personal responsibility of leaders, while strengthening inspection and supervision work, definitely not causing trouble for people and businesses, in accordance with practical requirements and legal regulations.

Regularly monitor and promptly guide localities to remove difficulties in the process of implementing and promoting land valuation and land price decisions. Establish a working group of the Ministry of Natural Resources and Environment to regularly monitor, inspect, urge and handle difficulties in land valuation of localities, agencies and units.

Chairman of People's Committee of provinces and centrally-run cities:

Focus on directing land valuation work, deciding on land prices according to authority, without going around in circles, causing inconvenience, delay, affecting the progress of investment project implementation; authorize the People's Committee at the district level to determine specific land prices according to the provisions of the Law on Organization of Local Government and Resolution No. 73/NQ-CP dated May 6, 2023 of the Government. Timely report to the Ministry of Natural Resources and Environment for guidance, resolving difficulties and problems in the implementation process.

Assign Deputy Prime Minister Tran Hong Ha to directly monitor and direct the Ministers of Justice, Finance, Construction and relevant Ministries and branches to proactively coordinate closely with the Ministry of Natural Resources and Environment to promptly guide localities to remove difficulties and obstacles related to land valuation work according to assigned functions and authorities.

Ministers, Chairmen of People's Committees of provinces and centrally-run cities are fully responsible to the Prime Minister for organizing and implementing this Official Dispatch.

The Government Office monitors and urges relevant ministries, agencies and localities to implement this Official Dispatch, promptly reporting to the Prime Minister any problems and difficulties in the implementation process.
