Reviewing the draft Resolution to remove difficulties and obstacles in implementing the Land Law

On the afternoon of October 27, at the National Assembly House, the Standing Committee of the Economic and Financial Committee held an expanded meeting to examine the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in implementing the Land Law.

Presenting some key contents of the draft Resolution, Minister of Agriculture and Environment Tran Duc Thang said that the purpose of drafting the Resolution is to fully and promptly institutionalize the views and policies of the Party and the State on land policy; to promptly remove bottlenecks and new issues arising in practice, contributing to the achievement of socio-economic development goals and improving the effectiveness and efficiency of land management and use.

The draft Resolution consists of 3 chapters and 13 articles. Chapter 1, comprising 2 articles, stipulates the scope of application and the subjects to which it applies. Chapter 2, comprising 9 articles, stipulates some mechanisms and policies to address difficulties and obstacles in the implementation of the Land Law. Chapter 3, comprising 2 articles, stipulates the organization of implementation, principles of application, and effective date of the Resolution.

According to Minister Tran Duc Thang, the draft Resolution adds three cases where the State can reclaim land for socio-economic development in the national and public interest; stipulates the conditions for land reclamation for national defense and security purposes, socio-economic development in the national and public interest; and specifies the basis for land reclamation in cases of land reclamation according to the progress of investment projects or according to the progress of land reclamation for compensation and resettlement support. The draft Resolution stipulates that the land price for calculating land compensation and resettlement land price will be calculated based on the land price in the land price table and the land price adjustment coefficient.

The draft Resolution also allows land users to choose between a one-time payment or annual payments for land leases, except for land used by public service units. In addition, it includes provisions on the mechanism for resolving land disputes under the jurisdiction of the People's Courts and stipulates some transitional provisions to address difficulties and obstacles in the implementation of the Land Law.

At the meeting, delegates unanimously agreed on the issuance of the Resolution and believed that many contents in the draft Resolution, once in effect, would contribute to removing obstacles and creating favorable conditions for localities and businesses.

Regarding land acquisition, compensation, and resettlement support in Article 3 of the draft Resolution, delegates noted that this is a crucial issue but still faces many practical challenges. Therefore, they proposed adding a provision stating that "the Chairman of the People's Committee at the commune level shall decide on land acquisition for compensation and resettlement support in the cases stipulated in Articles 78 and 79 of the 2024 Land Law, according to the progress of the investment project," to ensure clarity, transparency, and ease of understanding for relevant agencies and localities during implementation.

Clause 8 of Article 4 of the draft Resolution stipulates that "Violations of land law and the results of handling violations by land users must be publicly disclosed on the electronic portal of the provincial People's Committee. When allocating land, leasing land, or permitting changes in land use purposes, the competent authority is responsible for checking the above-mentioned information that has been publicly disclosed on the electronic portal of the provincial People's Committees."

To ensure interoperability and reduce the workload for implementing officials, it has been suggested that the Provincial People's Committee be responsible for submitting periodic reports on this matter to update the information on the Ministry of Agriculture and Environment's electronic portal.

Concluding the session, the Chairman of the Economic and Financial Committee, Phan Van Mai, acknowledged the heartfelt contributions of the delegates; and requested that the drafting agency incorporate these opinions as selectively as possible into the draft Resolution.

To further refine the draft Resolution, it is suggested that the regulations be thoroughly reviewed to ensure they align with the spirit and policies of the Central Committee; and that they be compared with existing laws, resolutions, and draft laws currently being submitted to the National Assembly to ensure consistency within the legal system and avoid creating new obstacles. At the same time, further research should be conducted on issues such as: land for equitization, BT projects, extensions of projects after expiration; and the resolution of land disputes.

The Chairman of the Economic and Financial Committee also requested the National Assembly's Ethnic Council and Committees, and relevant agencies to continue coordinating with the drafting and reviewing agencies, and to continue providing feedback to finalize the draft Resolution to the highest quality.
