Presenting some key contents of the draft Resolution, Minister of Agriculture and Environment Tran Duc Thang said that the development of the Resolution aims to fully and promptly institutionalize the viewpoints and policies of the Party and State on land policy; promptly remove bottlenecks and new problems arising in practice, contributing to the realization of socio-economic development goals, improving the effectiveness and efficiency of land use management.
The Draft Resolution consists of 3 chapters and 13 articles. Chapter 1 consists of 2 articles, regulating the scope of regulation and applicable subjects. Chapter 2 consists of 9 articles, regulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law. Chapter 3 consists of 2 articles, regulating the implementation organization, principles of application and enforcement of the Resolution.

According to Minister Tran Duc Thang, the draft Resolution adds 3 cases where the State reclaims land for socio-economic development for national and public interests; regulations on conditions for land reclaim for national defense and security purposes, socio-economic development for national and public interests; regulations on the basis for land reclaim in cases of land reclaim according to the progress of investment projects or according to the progress of land reclaim for compensation and resettlement support. The draft Resolution stipulates that land prices for calculating land compensation and resettlement land prices are calculated according to land prices in the land price table and land price adjustment coefficients.

The draft Resolution also allows land users to choose the form of land lease with one-time payment or land lease with annual payment, except for the case of land use by public service units. In addition, there are regulations on the mechanism for resolving land disputes under the jurisdiction of the People's Court and regulations on a number of transitional contents to resolve difficulties and obstacles in organizing the implementation of the Land Law.
At the meeting, delegates agreed to issue the Resolution and said that many contents in the draft Resolution, when effective, will contribute to removing difficulties and creating favorable conditions for localities and businesses.

Regarding land recovery, compensation, and resettlement support in Article 3 of the draft Resolution, according to delegates, this is an extremely important content but there are still many problems in practice. Therefore, it is recommended to consider and supplement the regulation "Chairman of the People's Committee at the commune level decides to recover land for compensation and resettlement support in the cases specified in Articles 78 and 79 of the 2024 Land Law according to the progress of the investment project" to ensure strictness, transparency, and ease of understanding for agencies and localities when implementing.

Clause 8, Article 4 of the draft Resolution stipulates that “Land law violations and the results of handling violations by land users must be made public on the Electronic Information Portal of the Provincial People's Committee. When implementing land allocation, land lease, and permission to change land use purposes, competent authorities are responsible for looking up the above information that has been made public on the Electronic Information Portal of the Provincial People's Committees”.

To ensure connectivity and reduce workload for implementing staff, there is a proposal to add content that the Provincial People's Committee is responsible for periodically reporting on this content to update information on the Electronic Information Portal of the Ministry of Agriculture and Environment.

Concluding the meeting, Chairman of the Economic and Financial Committee Phan Van Mai acknowledged the enthusiastic comments of the delegates at the meeting; requested that the drafting agency absorb the opinions in the spirit of "filtering" to the maximum to include in the draft Resolution.

To continue perfecting the draft Resolution, it is necessary to carefully review the regulations, ensuring that they are consistent with the spirit and policies of the Central Committee; review them with legal documents, resolutions and draft laws being submitted to the National Assembly to ensure consistency in the legal system, and not create new problems. At the same time, continue to research contents such as: equitized land, BT projects, extension of projects after expiration; settlement of land disputes...

The Chairman of the Economic and Financial Committee also requested the Nationalities Council and the National Assembly Committees, and relevant agencies to continue to coordinate with the drafting agency and the reviewing agency, and continue to provide comments to complete the draft Resolution with the highest quality.
