Mr. Le Anh ( An Giang ) has 200 m2 of land for perennial crops, now he wants to build a house with an area of 100 m2. He asked, what procedures do he need to follow to convert and build?
The Ministry of Agriculture and Environment responded to this issue as follows:
If you want to change the land use purpose from perennial crop land to residential land (house construction), the basis for changing your land use purpose is stipulated in Point a, Clause 3 or Clause 5, Article 116 of the 2024 Land Law, Clause 2, Article 22 of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization of authority of local authorities at 02 levels, decentralization, and decentralization in the land sector (corrected by Decision No. 2418/QD-BNNMT dated June 28, 2025 of the Minister of Agriculture and Environment).
His above-mentioned change of land use purpose falls under one of the cases of change of land use purpose that must be permitted by a competent state agency as prescribed in Point b, Clause 1, Article 121.
The authority to decide on permission to change land use purpose is the Chairman of the People's Committee at the commune level according to the provisions of Point m, Clause 1, Article 5 of Decree No. 151/2025/ND-CP.
The order and procedures for permitting change of land use purpose shall comply with the provisions of Article 227 of the 2024 Land Law.
Administrative procedures for land allocation, land lease, and change of land use purpose in the above case of Mr. are specified in Point 1, Section B, Part II of New administrative procedures, amended and supplemented administrative procedures in the land sector under the state management scope of the Ministry of Agriculture and Environment issued together with Decision No. 3380/QD-BNNMT dated August 25, 2025 of the Ministry of Agriculture and Environment.
