Continuing the working program of the 9th Session of the 15th National Assembly, on the morning of May 6, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly listened to Chairman of the Committee on Culture and Social Affairs Nguyen Dac Vinh present a report explaining, accepting and revising the draft Law on Teachers.
Rights and obligations of teachers
Regarding the rights and obligations of teachers and what they are not allowed to do, Chairman of the Committee on Culture and Society Nguyen Dac Vinh said that the National Assembly Standing Committee has received and directed the revision of the draft Law in the direction of clearly defining: Rights and obligations applicable to teachers in general; rights and obligations of teachers working in publiceducational institutions; rights and obligations of teachers working in non-public educational institutions. The contents on the rights and responsibilities of teachers and employees that have been stipulated in relevant laws will not be stipulated in the Law on Teachers.
In addition, absorbing the opinions of National Assembly deputies, the draft Law supplements at Point b, Clause 2, Article 8 the right of teachers to participate in the management and operation of enterprises established by higher education institutions, operating in the field of scientific development, application and technology transfer.
It is necessary to delegate recruitment authority to the Education sector.
Regarding the recruitment and use of teachers, the National Assembly Standing Committee found that it is necessary to assign recruitment authority to the education sector, creating conditions for the sector to be proactive in recruiting, using, managing, and developing teachers, meeting the requirements on quantity, structure, and quality; contributing to overcoming the situation of local surplus, shortage, and imbalance in the structure of teachers.
Incorporating the opinions of National Assembly deputies, the draft Law is adjusted to regulate the recruitment of teachers according to the level of education and training as in the draft Law. For schools of the People's Armed Forces, the recruitment of teachers is regulated by the Minister of Public Security and the Minister of National Defense. For other educational institutions, the recruitment of teachers is decided by the competent authority managing the educational institution. At the same time, the Government is assigned to specify in detail the contents related to the recruitment of teachers in public educational institutions and foreign teachers.
The National Assembly Standing Committee also recognized that the mobilization of teachers from public educational institutions is a new and necessary policy, creating conditions for the education sector to transfer teachers between public educational institutions to overcome local surplus and shortage, ensuring the quality of education for regions and areas.
Accordingly, Article 19 of the draft Law has been revised to clearly stipulate the subjects, principles of mobilization, mobilization authority, and cases in which teachers cannot be mobilized; adding cases of mobilizing teachers to work in ethnic minority areas, mountainous areas, border areas, islands, and areas with especially difficult socio-economic conditions to resolve policies for these subjects; assigning the Government to specify in detail the order and procedures for mobilizing teachers.

Policy to attract teachers
Regarding the retirement regime for teachers, Chairman of the Committee on Culture and Society Nguyen Dac Vinh said that many opinions of National Assembly deputies and relevant agencies agreed to reduce the retirement age for preschool teachers with the regimes as stipulated in the draft Law.
In addition, it is necessary and reasonable to stipulate that teachers with high qualifications, academic titles, and degrees, teachers working in specific specialized fields and sectors can have their working time extended and retire at an older age in order to take advantage of and exploit high-quality human resources; overcome the shortage of highly qualified teachers in a number of specific specialized fields and sectors that the country's development trend requires.
Accordingly, the draft Law clearly stipulates the conditions for implementing this policy when educational institutions have a need, teachers are healthy enough and voluntarily extend their working time; at the same time, it adds criteria to meet the standards and conditions of educational institutions. During the period of extended retirement age, teachers in public educational institutions shall not hold leadership or management positions and shall not be allowed to retain leadership or management position allowances.
Regarding salary policy, attraction and support policies for teachers, taking into account the opinions of National Assembly deputies, the draft Law stipulates that teachers' salaries are ranked highest in the administrative career salary scale system and have additional allowances depending on the nature of the job, by region to institutionalize the Party's policy in Conclusion No. 91-KL/TW dated August 12, 2024 on continuing to implement Resolution No. 29-NQ/TW on fundamental and comprehensive innovation of education and training; does not stipulate an increase of 1 starting salary level for teachers recruited and paid for the first time; at the same time, assign the Government to stipulate details.
In addition, the National Assembly Standing Committee has reviewed and made technical adjustments; reviewed specialized legal regulations to abolish, amend and supplement related contents and provisions on transitional provisions in Chapter IX, ensuring that the provisions of the draft Law do not conflict or overlap with current laws.
