Ho Chi Minh City Tax Officers directly support and guide taxpayers

In the context of increasingly transparent and modern tax management, Ho Chi Minh City Tax is stepping up inspection, supervision and strict handling of violations in the use of invoices, documents and tax payment. At the same time, the tax authority also strengthens propaganda and guidance for the business community to identify risks early, proactively prevent them, contributing to building a healthy and law-compliant business environment.

According to Head of Business Management Department No. 2 (Ho Chi Minh City Tax) Hoang Thi Ngoc Phi, violations related to invoices are being inspected, monitored and strictly handled by the tax authority in coordination with functional units. Ms. Phi said that according to Clause 7, Article 3, Decree No. 123/2020/ND-CP, illegal invoices include fake invoices, invoices that have not been coded by the tax authority or invoices with false content.

Based on this reality, the tax authority recommends that businesses absolutely do not buy, sell, lend or use invoices of other units. If detecting signs of counterfeit input invoices, businesses need to promptly report to the tax authority according to the instructions in Article 29 of Decree 123/2020/ND-CP for verification, avoiding unfortunate violations.

The Head of Business Management Department No. 2 emphasized that any act of buying and selling invoices or issuing invoices that do not reflect actual transactions will be strictly handled, with fines of up to 100 million VND for violating organizations. In case of signs of crime, the tax authority will transfer the file to the police to consider criminal responsibility.

Also according to Decree 123/2020/ND-CP, enterprises are obliged to issue electronic invoices with all required criteria, at the right time and with the correct transaction value. Registering to use electronic invoices with the tax authority before issuance is a mandatory requirement in the current electronic tax management system.

In case of violation, depending on the nature and level, enterprises can be fined from 4 to 8 million VND if they issue invoices at the wrong time, or from 20 to 50 million VND for using illegal invoices. These fines, according to Ms. Phi, "are not only a deterrent, but also aim to raise the awareness of self-compliance with tax laws among the business community."

Regarding tax payment obligations, according to Article 55 of the Law on Tax Administration, taxpayers must pay the full amount to the State budget within the time limit stated on the notice. In case of late payment, they will have to pay a late payment fee of 0.03% per day according to Article 59 of the Law. If the enterprise deliberately delays, the tax authority has the right to apply coercive measures to recover tax debts according to Article 124, including deducting money, freezing accounts, temporarily suspending customs procedures, stopping the use of invoices, seizing assets, or revoking business registration certificates.

Notably, for businesses with tax debts of over VND500 million and overdue for 120 days, the legal representative may be temporarily suspended from leaving the country. Therefore, the tax authority recommends that businesses proactively review data, periodically compare tax debts, and ensure full and timely payment of financial obligations. In case of cash flow difficulties, it is possible to request an extension or gradual payment of taxes; the tax authority will consider and create conditions to temporarily not apply enforcement measures.

Ho Chi Minh City Tax Department Head Doan Minh Dung said that after implementing the two-tier local government model, the city's tax sector has proactively implemented many programs to support taxpayers to overcome difficulties and restore production and business. In particular, policies on tax exemption, reduction, and extension of land rent issued by the National Assembly and the Government have been promptly implemented, contributing to removing difficulties for the business community.

Ho Chi Minh City Tax always considers taxpayers as the center of service, not just as management objects. The city's tax sector commits to continue to accompany, listen, share and create the most favorable conditions for businesses to feel secure in investing, expanding production, contributing to the overall socio -economic development of the city.
