Ho Chi Minh City: Commune-level People's Committees implement support levels related to land recovery previously authorized to district-level

The People's Committee of Ho Chi Minh City assigned the People's Committees of 102 wards and communes in the city (before the merger) to decide on measures and other support levels related to land recovery for each specific project that the city had previously authorized to the People's Committees of districts and Thu Duc City, according to the provisions of the 2024 Land Law.

The People's Committee of Ho Chi Minh City has just issued Decision No. 3564/UBND-DT on deciding on other measures and support levels for each specific project, sent to the Department of Agriculture and Environment (NN-MT), Department of Justice, Department of Finance, Department of Construction, People's Committees of 102 wards and communes in Ho Chi Minh City before the merger.

Accordingly, the City People's Committee approved the proposal of the Department of Agriculture and Environment in Official Dispatch No. 9752/SNNMT-BTTDC dated October 27, 2025 regarding the above content.

Specifically: Assign the People's Committees of 102 wards and communes in Ho Chi Minh City before the merger to study Decision No. 5516/QD-UBND dated December 2, 2024 of the City People's Committee on piloting the authorization for the People's Committee of Thu Duc City and the People's Committees of districts to decide on other measures and support levels for each specific project to ensure housing, stabilize life and production for people whose land is recovered, and property owners when the State recovers land in the city according to Clause 2, Article 108 of the 2024 Land Law.

The purpose of the above review and research is to proactively decide on other measures and support levels to ensure housing, stabilize life and production for people whose land is recovered, property owners for each specific project according to the authority prescribed in Clause 1, Article 10 of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government . The implementation period is until December 31, 2025 to implement continuously and synchronously according to the provisions of the Land Law 2024, in time for disbursement progress according to the direction of the City People's Committee.

Previously, in Decision No. 5516/QD-UBND dated December 2, 2024, the City People's Committee authorized the People's Committee of Thu Duc City, the People's Committees of districts and towns with the above content. Specifically, the authorized contents include: Support for land used by religious organizations and affiliated religious organizations that have been transferred, donated, donated, or offered since July 1, 2004 or are not eligible to be considered for land use rights.

Support for cases ineligible for land compensation: For cases where households and individuals using land are ineligible for land compensation according to the provisions of Article 95 of the Land Law and Article 5 of Decree No. 88/2024/ND-CP, support will be considered based on the origin, process, time of land use, and reasons for ineligibility for compensation.

Support for cases where land has been granted a land use right certificate or a land use right certificate, ownership of assets attached to land with the purpose of use being agricultural land, but households and individuals have arbitrarily transferred the land use purpose, built houses before July 1, 2014 with separate premises, and actually reside on the recovered land plot.

Support for land of organizations using land within the announced road boundary that has now been decided to be recovered to implement the project.

Support for houses and constructions serving the daily life of households, individuals, and people of Vietnamese origin residing abroad when the State reclaims land and must partially dismantle it while the remaining part still ensures technical standards according to the provisions of law.

Support for housing and construction works that are not housing owned by households and individuals without legal and valid documents.

Support for houses and construction works that are not houses owned by households or individuals with construction permits (including temporary construction permits) but whose current status is different from the construction permit.

Support for houses and construction works that are not houses owned by households or individuals that are granted a Certificate but during use have been renovated or repaired to increase the area compared to the certificate, the additional difference in area will be supported according to regulations.

Support for the area within the road boundary, protection corridor of dykes, rivers, streams, canals, ditches and public works of public property origin that the State previously did not sell or value, and is currently being used by households and individuals...

In addition, it also authorizes support for other contents such as: Support for additional resettlement quotas; support for temporary residence cases; support for investment costs on remaining land in cases with supporting documents and certificates...
