On March 14, the Department of Planning and Investment (DPI) of Quang Nam province reported the results of the investigation into the anonymous complaint related to bidding at Quang Nam College (Hung Vuong Street, Tam Ky City).
Previously, the authorities of Quang Nam province received an anonymous complaint about the bidding for the project to repair the head office, lecture hall area C, and student dormitory in 2022 of Quang Nam College, with a package value of more than 4.89 billion VND.
Quang Nam College was newly established at the end of May 2021 on the basis of merging 6 colleges in Quang Nam province.
In the petition, the whistleblower said that during the online bidding process, only one contractor participated and won the bid, which was Quang Da Consulting and Construction Company Limited (Tra Cai block, Hoa Thuan ward, Tam Ky city).
The complaint stated that the contractor's capacity and experience were limited, but Phuc Loc Technical Consulting and Investment Joint Stock Company (Ai Nghia town, Dai Loc district, Quang Nam province) and the investor (Quang Nam College) and Quang Da Company colluded with each other, creating bidding documents with standards and regulations that were favorable to Quang Da Company, so they won the bid...
In addition, the complaint alleges that Mr. Nguyen Thanh Hung, Director of Quang Da Company, is a classmate of Ms. Vu Thi Phuong Anh - Principal of Quang Nam College. The two have a close relationship with each other, so they were given preferential treatment to win the bid.
Through verification, the Department of Planning and Investment of Quang Nam province determined that the bidding documents prepared by the consulting unit Phuc Loc Company, appraised by Toan Thanh Consulting Joint Stock Company, and approved by the investor stated evaluation criteria that were not in accordance with regulations, were not suitable for the scale and technical nature of the bidding package, causing restrictions on bidders' participation.
In addition, the bidder's bidding documents did not meet the bidding documents and did not have sufficient basis for evaluation and approval of the winning bid results. The bidding consultancy unit and the investor did not clarify the bidding documents as prescribed in Article 16 of Decree No. 63/2014/ND-CP dated June 26, 2014 of the Government .
Regarding the accusation that the bidding document preparation unit, the bidding unit and the investor colluded with each other, the Department of Planning and Investment said there was not enough basis to verify. In addition, the Department of Planning and Investment concluded that the other two accusations were incorrect or unfounded.
Based on legal grounds and comparing with related records and documents, the Department of Planning and Investment of Quang Nam province concluded that the contents of the anonymous complaint have no basis to determine any violation of the law.
However, the Department affirmed that in the process of organizing the implementation of the project bidding, the investor and the consulting units still had some limitations and errors. In addition to the violations as mentioned above, the Department of Planning and Investment determined that the investor, Quang Nam College, hired a consulting unit to appraise the bidding documents and appraise the contractor selection results without the competent authority approving the contractor selection plan.
Associate Professor, Dr. Vu Thi Phuong Anh has just been appointed as Principal of Quang Nam College from June 2021.
The Department of Planning and Investment recommends that the People's Committee of Quang Nam province direct Quang Nam College to organize a review of the collective and individuals involved in the bidding for the above project. The Department of Planning and Investment will carry out sanctioning procedures according to its authority for violations by related units in accordance with regulations.
It is known that Quang Nam College was newly established at the end of May 2021 on the basis of merging 6 colleges in the area. At that time, the People's Committee of Quang Nam province announced the decision to transfer and appoint Associate Professor, Dr. Vu Thi Phuong Anh, Vice Rector of Quang Nam University as Rector of Quang Nam College from June 1, 2021.
