5 groups of subjects are eligible to buy social housing without having to draw lots according to the Housing Law 2023. The priority order and list are considered based on the time of application submission.

Priority order for buying social housing: Who gets considered first?

According to Point d, Clause 1, Article 79 of the Housing Law, when subjects have the same standards and conditions, support is implemented in order of priority for:

People with revolutionary contributions

Relatives of martyrs

People with disabilities

People are resettled by purchasing or leasing social housing.

The law clearly stipulates: "In case a subject is entitled to many different support policies, he/she shall be entitled to the highest level of support policy."

Priority list is considered based on the time of application submission.

In Clause 2, Article 38 of Decree 100/2024/ND-CP, the law stipulates:

“The priority group list is arranged in order according to the time of application submission. Apartments for priority groups are arranged in order of the Priority List until they are exhausted, the remaining groups will continue to participate in the lottery..”

Thus, those in the priority group are allocated apartments first. When the priority apartment fund runs out, the remaining subjects must participate in the lottery.

Groups eligible to buy social housing under new law

Pursuant to Article 76 and Clause 1, Article 77 of the 2023 Housing Law, the following subjects are eligible to purchase social housing when meeting the prescribed conditions:

1. People with meritorious services to the revolution and relatives of martyrs are eligible for housing improvement support according to the provisions of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution.

2. Poor and near-poor households in rural areas.

3. Poor and near-poor households in rural areas frequently affected by natural disasters and climate change.

4. Poor and near-poor households in urban areas.

5. Low-income people in urban areas.

6. Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.

7. Officers, professional soldiers, non-commissioned officers of the people's armed forces, police workers, civil servants, defense workers and public employees currently serving in the army; people working in cryptographic work, people working in other cryptographic organizations receiving salaries from the state budget currently working.

(Note: Subject 7 must not have enjoyed housing support policy for people's armed forces)

8. Cadres, civil servants and public employees as prescribed by law on cadres, civil servants and public employees.

9. The subject has returned the public housing according to the provisions of Clause 4, Article 125 of the Housing Law, except in cases where the public housing was revoked due to violations of the provisions of this Law.

10. Households and individuals whose land is recovered and whose houses must be cleared and demolished according to the provisions of law but have not yet received compensation from the State in the form of houses and residential land.

Additionally, by law:

“Based on local conditions, the Provincial People's Committee can prescribe support for resolving the sale, hire-purchase, and rental of social housing for subjects 2 and 3"./.
