Detect and handle violations promptly
Before the merger of commune-level and provincial-level administrative units, the People's Committees of the two provinces of Bac Giang and Bac Ninh (old) issued official dispatches requesting departments, branches and localities to strengthen state management of land in the context of streamlining the apparatus. Although the functional forces have focused on patrolling and monitoring, acts of land encroachment and arbitrary conversion of land use purposes still occur in many forms. In some urban areas and industrial zones, high land prices have caused many people to seek ways to take advantage of agricultural land to build factories for sale or lease, making illegal profits. Therefore, as soon as the new government apparatus came into operation, the People's Committees of communes and wards in the province developed plans, requested departments and specialized agencies to urgently review and classify each violation; specifically assess to have handling measures. Resolutely prevent and not let new violations arise and persist.

Tan Tien Ward was established after merging two wards: Tan Tien, Huong Gian and Xuan Phu commune. The administrative boundaries were expanded to include both urban and rural areas, creating new space for local development. However, agricultural land areas adjacent to residential areas are at risk of encroachment. Through monitoring work and reported sources, from the beginning of July until now, the ward's functional forces have discovered 10 violations, mainly illegal construction on agricultural land. In which, Mr. Duong Van Tong's household (Van Son residential group) built a frame and shot a corrugated iron roof on agricultural land with an area of nearly 100 m²; Mr. Nguyen Duy Sy's household (Dong Tien residential group) built a frame of pillars made of wood and iron, shot a roof of iron boxes on an area of more than 100 m²... Determining the nature of the violation, the working group led by the Vice Chairman of the Ward People's Committee drew up a record and requested the families to dismantle and restore the original status. Under the supervision of the authorities, the illegal constructions have been demolished. Mr. Nguyen Thanh Tung, Deputy Head of the Economic , Infrastructure and Urban Department of Tan Tien Ward said: “Most of the violations occurred before the merger. After being explained the legal regulations, people were fully aware and demolished the illegal constructions themselves. We will continue to conduct regular inspections to prevent new violations.”
In Phu Khe ward, the authorities have increased inspections of interspersed agricultural land areas and areas bordering craft villages. Since the beginning of July, the ward's professional agencies have discovered 7 cases of violations in construction on agricultural land such as fencing, corrugated iron fences, etc. The ward has assigned officers to make records of the violations and sent notices requesting households to dismantle the constructions and return the land to its original state.
In other wards and communes in the province, the work of monitoring and handling land violations is also being simultaneously deployed. Local authorities have established interdisciplinary working groups to increase the effectiveness of land management right from the beginning.
Applying technology, attaching individual responsibility
Implementing the 2-level local government model, the responsibility for state management in the field of land is strongly decentralized to the commune level. However, the difficulty for the communes and wards after the arrangement is that the administrative boundaries are expanded, the population is dense, so it is very difficult to control. Most violations are located on the border between residential land and agricultural land, along ponds and lakes. People often take advantage of early morning and late night to expand and build illegally. Meanwhile, the staff with expertise in the field of land in the wards and communes is not arranged much.

To increasingly tighten land management, localities in the province have been implementing many solutions such as building a team of collaborators to monitor and protect mineral resources. Canh Thuy Ward has taken the initiative to apply technology to remotely manage land. Every two days, commune officials use flycams to inspect the field. This device helps quickly detect signs of illegal leveling and construction, saving inspection time and increasing accuracy. Mr. Phan Van Giang, Chairman of Canh Thuy Ward People's Committee said: "Because the area is large, the ward encourages officials to use support tools such as flycams to promptly detect violations". In Kep Commune, the Chairman of the Commune People's Committee has issued a decision to establish an inspection team to handle administrative violations in the fields of land, minerals, construction, environment, etc. In which, specific responsibilities are assigned to each member. The goal is to detect early and promptly handle new violations; for violations that have been handled, focus on "post-inspection".
According to the Department of Agriculture and Environment, to improve the effectiveness of land management, in the immediate future, the specialized units of the Department and localities will focus on inspecting and urging the implementation of Directive No. 19-CT/TU, dated June 11, 2020 and Conclusion No. 120-KL/TU dated August 8, 2021 of the Standing Committee of the Bac Giang Provincial Party Committee (before the merger) on strengthening inspection and examination to handle violations in land management and use; Conclusion No. 739-KL/TU dated June 12, 2023 of the Standing Committee of the Bac Ninh Provincial Party Committee (before the merger) on handling cases of unauthorized land allocation, encroachment, and arbitrary change of land use purposes in the province. Strengthen the publicity and transparency of planning information and land use plans at the commune level; accelerate the progress of land measurement and construction of land databases for the remaining communes; Regularly update land fluctuation information into the database to ensure it is correct, complete, clean, and alive.
Wards and communes set up hotlines to receive feedback and publicize information on handling violations on the electronic information portal. At the same time, mobilize people to participate in monitoring and reporting violations. The general spirit is that all violations must be detected and strictly handled; leaders who are negligent and allow serious violations to occur will be held accountable according to regulations. The merger of the apparatus is an opportunity to reorganize management methods and promote the role of grassroots cadres - those who directly "guard the gate" and prevent violations in the locality.
