Recruitment and deployment of teachers are hampered by overlapping responsibilities between the education sector and local authorities.

The regulation that allows the Director of the Department of Education and Training to recruit and transfer teachers, administrators, and staff in public education institutions under their management is appropriate in practice.

The Decree detailing certain provisions of the Law on Teachers stipulates the authority to transfer teachers, stating that the Chairman of the People's Committee at the commune level has the authority to transfer teachers, educational institution administrators, and staff in public educational institutions under their jurisdiction.

The Director of the Department of Education and Training recruits and assigns teachers, administrators, and staff in public educational institutions under their management authority, and in educational institutions spanning two or more commune-level administrative units.

Teacher transfers are carried out when teachers have a need; ensuring that teachers are able to teach conveniently and work with peace of mind. Transfers must be made with the consent of the school where the teacher is currently working, and the receiving institution must have a need for the position and it must be suitable for the teacher.

According to the Ministry of Education and Training , preschool education currently has the most significant shortage of teachers.

The decree also stipulates the principles for teachers to teach across schools and levels. Specifically, the assignment of teachers to teach across schools and levels must take into account the geographical conditions, practical circumstances, and the opinion of the head of the educational institution.

The evaluation of teachers teaching across schools and levels will be carried out by the head of the educational institution where the teacher is currently working under contract, based on feedback from the school where the teacher is giving additional instruction as assigned.

According to assessments, preschool and primary education institutions currently lack autonomy in personnel management. The management and utilization of teachers are still influenced by multiple agencies, but this lacks flexibility, leading to localized teacher shortages and surpluses. Universities, despite having autonomy policies, still face difficulties and are somewhat limited in their proactive approach.

Revise policies based on practical shortcomings.

Previously, some argued that the authority to recruit teachers should be given to schools because schools are the ones who best understand the teacher shortages and the required quality. However, many also raised concerns about the lack of objectivity when schools are given the power to recruit teachers.

The Ministry of Education and Training also explained that many commune-level officials in charge of education and training lack experience in state management of education. Therefore, decentralizing the recruitment, acceptance, assignment, secondment, and transfer of teachers and staff in educational institutions within the province to the Department of Education and Training is appropriate given the existing conditions and capabilities of the Department.

The Department of Education and Training taking the lead in recruiting and transferring teachers will help reduce intermediaries, standardize recruitment quality, save costs, and increase opportunities for applicants, while also contributing to overcoming the problem of localized teacher shortages and surpluses.

On the other hand, the Ministry of Education and Training also pointed out that, for a long time, the overlap between education sector management and local government management has created shortcomings in the development of the teaching staff.

Educational institutions have the authority to employ and manage teachers, but they lack the authority to recruit, appoint, or transfer teachers, leading to issues such as teacher shortages or surpluses, untimely transfers and additions, and teachers whose quality does not meet job requirements.

Furthermore, the use of teachers in localities and educational institutions still faces many obstacles and shortcomings. The transition of teachers from lifelong tenure to contract-based employment, with salaries based on job position, lacks specific regulations, making it impossible to transfer or second teachers from more favorable areas to disadvantaged regions.

In particular, current regulations do not clearly address the reassignment, transfer, or placement of teachers to teach across schools and levels, only allowing for secondment. In reality, teacher management over the years has shown that relying solely on secondment is not suitable for the specific situations requiring teachers.

Assessing the impact, the Ministry of Education and Training believes that adjusting the policy will make better use of resources. The reassignment of teachers from public educational institutions is a new and necessary policy, providing a basis for assigning teachers appropriately to their professional activities and the requirements of the sector; creating a favorable environment for teachers to fully develop their creative abilities.
