Ministry of Science and Technology recommends "outsourcing" law-making activities

On the afternoon of November 3, Deputy Minister of Justice Phan Chi Hieu led an interdisciplinary inspection team to work with the Ministry of Science and Technology (MOST) on the implementation of inspection, review, and systematization of legal documents at this Ministry.

At the working session, the interdisciplinary inspection team inspected legal documents issued by the Minister of Science and Technology that are in legal effect; inspected the implementation of inspection, review and systematization of legal documents at the Ministry of Science and Technology, especially in the years 2022-2024 and 9 months of 2025.

The inspection team assessed that the leaders of the Ministry of Science and Technology had paid close attention to directing, issuing specific plans, arranging personnel and improving the capacity of the legal staff. The work of self-inspection, inspection according to authority and reviewing and systematizing documents was carried out regularly, closely following the plan and achieving many positive results, with the number of documents processed each year being higher than the previous year.

However, the Delegation discovered that some issued documents had content that was not in accordance with the provisions of the law. The quality of self-inspection work needs to be further improved, as errors that were later pointed out by the Delegation under its authority have not been promptly detected.

Deputy Minister of Justice Phan Chi Hieu suggested that the Ministry of Science and Technology increase resources for legal work, especially to improve the staff, enhance training and professional development, and allocate separate funds for inspection, review, and systematization of legal documents. In particular, the Ministry needs to promote the mechanism for receiving and promptly handling feedback and recommendations from people, businesses, and press information on legal regulations in the fields under the Ministry's management.

On the side of the Ministry of Science and Technology, Deputy Minister Bui The Duy said that the Ministry will immediately issue a specific action plan to completely handle the errors in the documents that the Delegation pointed out, determined to complete it in November.

In order to achieve better results in the work of inspecting, reviewing and systematizing legal documents, the Ministry of Science and Technology recommends that the Ministry of Justice regularly provide professional training for civil servants doing this work at ministries, branches and localities; pay attention to guiding ministries, branches and localities to ensure human resources and funding for this work; create conditions for civil servants doing this work of the Ministry of Science and Technology to participate in inspection teams of the Ministry of Justice to be able to learn experience, improve skills and expertise...

On this occasion, Deputy Minister Bui The Duy proposed a breakthrough solution to the Inspection Team and the Ministry of Justice. That is to study a mechanism that allows "outsourcing" some activities in the law-making process to qualified outside units and experts. The socialization of some stages such as research, drafting, consulting, etc. will help reduce the burden on the state apparatus, take advantage of high-quality human resources in society and improve the professionalism and quality of documents.
