Additional sanctions for cases of failure to implement monitoring conclusions

Kinhtedothi - On the morning of November 29, discussing at the hall about the Draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils, National Assembly deputies contributed many ideas to improve the effectiveness of the People's Council's supervisory activities.

Proposal to supplement the responsibilities of agencies and organizations under supervision

Giving suggestions for effective supervision, delegate Huynh Thi Hang Nga (National Assembly Delegation of Tra Vinh province) paid attention to the responsibilities of agencies, organizations and individuals subject to supervision. The delegate suggested that the Drafting Committee add regulations on the responsibilities of the People's Committee in places where there is no People's Council at the same level, to send the decisions they have issued to the People's Council at the higher level no later than 3 days from the date of signing the document.

Delegates proposed to add more regulations on specific mandatory responsibilities for agencies, organizations and individuals under supervision. Add truly effective solutions to strengthen monitoring, urging, and binding responsibilities of agencies under supervision, ensuring full, timely, and serious implementation of conclusions and recommendations of supervision; add regulations on sanctions in cases where agencies and individuals fail to implement conclusions and recommendations within the deadline or do not implement them properly. At the same time, stipulate the responsibility of media agencies in reflecting the situation and results of implementing conclusions and recommendations of supervision; strengthen the responsibility for monitoring and urging the implementation of conclusions and recommendations of supervision.

Sharing this view, delegate Vu Thi Lien Huong (National Assembly Delegation of Quang Ngai province) commented on Clause 2, Article 7 of the Draft Law stipulating the responsibilities of agencies, organizations and individuals under supervision.

The delegate said that the Draft Law only amends and supplements Clause 2, stipulating that the subject is the Council of Judges of the Supreme People's Court, the Chief Justice of the Supreme People's Court is responsible for sending the legal documents it has issued to the National Assembly Standing Committee; and at the same time, to the Ethnic Council, relevant National Assembly Committees for supervision. The delegate suggested considering amending and supplementing Clause 4, which stipulates the handling of responsibilities of agencies, organizations, and individuals subject to supervision in implementing resolutions, conclusions, requests, and recommendations of the supervision subject.

"Specify the acts, nature, level of violations, order and procedures to ensure legal basis for implementation, and enhance the effectiveness and efficiency of supervision by elected bodies," said delegate Lien Huong.

Increase the People's Council's supervisory power over central agencies at the same level

Delegate Nguyen Ngoc Xuan (National Assembly Delegation of Binh Duong Province) said that through local supervision activities, People's Councils in many places proposed that the National Assembly consider adding and expanding the subjects of supervision in Article 5 of the current Law.

Specifically, the People's Council has the right to supervise the activities of central agencies in the locality such as: Tax Department, Customs, Social Insurance, State Bank at the same level...; at the same time, it is recommended to consider adding People's Council delegates with the right to question the heads of vertical agencies of the central government operating in the locality.

Delegate Ngoc Xuan analyzed that, according to Article 113 of the Constitution and Clause 2, Article 5 of the Law on Supervisory Activities of the National Assembly and People's Councils, the scope of supervision of People's Councils at the local level is very wide; covering all subjects and fields in the locality, including agencies, organizations and individuals in complying with the Constitution and laws, ensuring that the laws are implemented synchronously, uniformly and effectively.

Practice shows that competent agencies, units, individuals, and other agencies and organizations in society must comply with the law and must implement solutions and measures for socio-economic development, national defense and security as decided by the People's Council, including vertical agencies of the Central Government in the locality.

In the current context of strong decentralization and delegation of power, the People's Council is given more authority in promulgating policies, supporting facilities, wages, and allowances for social beneficiaries, defense and security forces; supporting budget allocations for social policy banks; funding for investment projects and supporting operations of central agencies at the local level...

The official regulation for the People's Council to supervise the activities of the same-level central State agencies located in the locality aims to perfect the mechanism of controlling State power in the locality. Thereby, helping the Central Government to effectively manage the implementation of policies and laws in the locality, while ensuring that the Central Government's orientations and goals assigned to the locality are effectively implemented.

Therefore, the delegates recommended that the National Assembly consider adding the authority to supervise the activities of central agencies at the local level to the People's Councils at the same level and stipulate the right of People's Council delegates to question the heads of those agencies.
