Ministry of Health's latest guidance on payment of ARV drugs from health insurance sources

In the document signed and issued by Deputy Minister of Health Le Duc Luan, the Ministry of Health guides relevant units to make payment for ARV drugs from health insurance sources for ARV drug procurement packages in the period of 2024-2025 (the number of ARV drugs that the contractor has issued financial invoices to the Health Insurance Appraisal Center and multi-line payment by February 28, 2025) as follows:

For the number of ARV drugs used for patients up to December 31, 2024 , Vietnam Social Security (VSS) and the Ministry of Finance will pay the cost of the number of ARV drugs used by patients up to December 31, 2024 to the contractor and liquidate the contract with the contractor according to regulations.

For ARV drugs used for patients from January 1, 2025 (including the number of drugs imported in 2024 and remaining in stock at medical facilities after December 31, 2024 and the number of drugs imported by medical facilities from January 1, 2025 to February 28, 2025): Vietnam Social Security and the Ministry of Finance are responsible for notifying the remaining unpaid ARV drug costs to the Social Security agency and contractors before November 10, 2025 to compare payment data of health insurance medical examination and treatment facilities.

Directing Social Insurance of provinces and centrally run cities to advance, pay, and settle ARV drugs used for patients with health insurance cards with health insurance medical examination and treatment facilities from January 1, 2025 according to the provisions of law.

Medical facilities that have signed contracts for medical examination and treatment under health insurance with the Social Insurance agency are responsible for: Reviewing and checking the quantity of imported, exported, and stored drugs and preparing a report on imported, exported, and stored drugs in stock up to February 28, 2025.

Conduct inventory and prepare a Drug Inventory Record up to February 28, 2025. Compare the quantity of drugs on the Import, Export, and Inventory Report with the Inventory Record. Confirm the inventory reconciliation data with the contractor. Take full responsibility before the law for the accuracy of the drug inventory data at the health insurance medical facility. The time to complete the data confirmation is before November 15, 2025.

Health insurance medical examination and treatment facilities shall sign contract appendices with contractors based on the drug import data compared from January 1, 2025 to February 28, 2025 as mentioned above and proceed to pay for the imported drugs that have not been paid to contractors according to the actual inventory, with confirmation signed by the Social Insurance agency (Center for Control of Electronic Social Insurance and Health Insurance Payments).

For the ARV drugs that the contractor has issued financial invoices to the Health Insurance Assessment and Multi-line Payment Center by February 28, 2025, the contractor will carry out the procedure of "adjusting and replacing electronic invoices" from the Health Insurance Assessment and Multi-line Payment Center to transfer to the Health Insurance medical examination and treatment facilities according to the total allocated quantity. This allocated quantity is mechanically accumulated from the previously allocated detailed quantity of the merged Health Insurance medical examination and treatment facilities.

Health insurance medical examination and treatment facilities are responsible for paying the contractor within 90 days from the date the contractor issues an adjustment to replace the electronic invoice. The Electronic Social Insurance and Health Insurance Payment Control Center and the contractor are responsible for signing a record confirming the data, adjustment content, and replacement of the electronic invoice.

For medical examination and treatment facilities that have not signed contracts with the Social Insurance Agency, it is recommended that the Social Insurance Agency quickly coordinate to sign contracts with medical facilities and complete the contract signing before November 15, 2025.

Payment for ARV drug costs from January 1, 2025 for patients using the health insurance fund with the social insurance agency signing a health insurance medical examination and treatment contract according to current regulations (like payment for other drugs). Health insurance medical examination and treatment facilities must pay the contractor for the cost of lost, damaged, or expired drugs caused by the health insurance medical examination and treatment facility to the contractor according to regulations.
