On September 23, the Ministry of Education and Training issued Circular 21 regulating the regime and salary for teaching overtime hours for teachers in public educational institutions. The Circular takes effect from the date of signing. In Circular 21, the Ministry of Education and Training adjusted the formula for calculating the salary for a teaching period of university lecturers, from which universities have a basis for calculating the salary for teaching periods exceeding the regulations for lecturers.
Specifically, the salary for one teaching period of university and college lecturers is calculated as follows:
The above formula is also applied to cadres and lecturers at training and fostering facilities of ministries, ministerial-level agencies, government agencies, political organizations, socio-political organizations, and political schools of provinces and centrally-run cities. The above formula does not apply to schools under the Ministry of Public Security and the Ministry of National Defense.
According to the Ministry of Education and Training, the above formula is adjusted to comply with the regulations on standard teaching hours for lecturers according to current regulations (equivalent to 600 - 1,050 administrative hours).
The formula for calculating salary for overtime hours (extra teaching hours) is still calculated as before: salary for 1 extra hour = salary for 1 teaching hour x 150%. Salary for extra teaching hours/school year = number of extra teaching hours/school year x salary for 1 extra teaching hour.
The time for paying overtime pay to teachers is after the end of the school year (after June 30 every year). In case of retirement, resignation, transfer or assignment of teachers, the payment of overtime pay is made at the time of the relevant decision of the competent authority.
Circular 21 also stipulates that the total number of extra teaching hours per year for teachers (at all levels, not just university level) is no more than 200 hours.
Pursuant to the provisions of Circular 21 and relevant legal provisions, universities, colleges, training and fostering establishments of ministries, ministerial-level agencies, government agencies, political schools of provinces and centrally-run cities shall, based on actual conditions, prescribe the payment of overtime teaching wages at their units.
