The right to recruit and mobilize teachers is an issue that many National Assembly deputies expressed their opinions on during the discussion session in groups this morning, November 17, on the draft Resolution of the National Assembly on a number of specific and outstanding mechanisms and policies to make breakthroughs in education and training development.
Article 3 of the draft resolution stipulates: “The Director of the Department of Education and Training exercises the authority to recruit, receive, mobilize, transfer, and second teachers, educational managers, and staff in public preschool, general education, and continuing education institutions in the province, ensuring unified State management in accordance with the provisions of law.”
Overcoming the surplus and shortage of teachers
Delegate Hoang Van Cuong ( Hanoi delegation) said that giving the right to recruit and mobilize teachers from kindergarten to high school to the Department of Education and Training is appropriate. This will overcome the current situation of surplus and shortage of teachers that cannot be mobilized. Besides, the Department's organization of recruitment will ensure the quality of human resources for teachers for the whole locality.
“This also makes it easier for teachers to apply. They won’t have to fill out multiple applications to apply in multiple places,” said Mr. Cuong.
Sharing the same view, delegate Nguyen Thi Lan (Hanoi delegation) said that giving the right to recruit to the departments of education and training is very correct to solve the problem of teachers. Analyzing more specifically, delegate Nguyen Tuan Thinh (Hanoi delegation) said that if the task of recruiting teachers is assigned to the People's Committees at the commune/ward level, it will not be feasible because there is not enough human resources to organize and implement it.
In addition, delegate Thinh also suggested that recruitment must be linked to the locality. When applying for recruitment, teachers must clearly register to which educational institution they are applying for, not to be recruited in general and then the department will mobilize and arrange them because currently the area of a province is very large.

“According to the Law on Education, the department only manages high schools and above, from middle schools and below are managed by the commune, so giving the authority to mobilize to the department level is unreasonable. To avoid overlap and problems, I suggest that the Department of Education organize recruitment but arrange, mobilize, second, and assign management staff and teachers to the commune level. The assignment of work and change of job positions for teachers and staff in educational institutions must be assigned to the school,” said delegate Nguyen Tuan Thinh.
Still many concerns
Delegates believe that assigning education department directors to recruit teachers is a good measure to overcome the local teacher surplus and shortage in localities, but they also have many concerns.
Delegate Tao Van Giot (Lai Chau delegation) is concerned that this is contrary to the spirit of strong decentralization to localities. Accordingly, the delegate suggested that the authority to recruit preschool, primary and secondary school staff should be transferred to the commune level to be proactive and linked to the responsibility of the head.
However, based on local reality, delegate Sung A Lenh (Lao Cai delegation) said that if the recruitment authority is given to the commune level, it will be a challenge for communes in difficult areas. "If the communes are allowed to recruit, it will be very difficult to attract candidates who are willing to go to difficult areas, and even have to switch to recruitment instead of exams," delegate Sung A Lenh said. Accordingly, delegate Sung A Lenh said that the Department of Education and Training's recruitment and transfer of teachers is appropriate, especially for difficult localities like Lao Cai. Based on this reality, delegate Sung A Lenh also recommended that there should be a specific policy mechanism, strong enough to attract teachers to difficult areas.
From another perspective, delegate Dang Thi My Huong (Khanh Hoa delegation) said that the draft resolution gives the right to recruit and transfer to the director of the Department of Education but does not clearly stipulate the mechanism for handling individuals if there is negativity, harassment, abuse of power, and accountability of the head. This creates potential risks. Therefore, delegate Huong suggested that the draft resolution needs to supplement the monitoring and transparency mechanism by building a human resources database, publicizing quotas, lists of successful candidates, transfer criteria, and designing an independent inspection mechanism./.
