Speed up progress in planning work
On the morning of June 28, continuing the 7th Session of the 15th National Assembly , the National Assembly discussed in the hall the draft Law on Urban and Rural Planning.
Speaking at the National Assembly, National Assembly Delegate Trieu Thi Huyen (Yen Bai delegation) expressed agreement with the draft Law on Urban and Rural Planning and the review report of the Economic Committee.
Regarding the specific issue, the delegate said that Clause 2, Article 10 stipulates that the funding sources for urban and rural planning activities include three sources: public investment funding from the State budget, regular expenditure funding from the State budget, and funding sponsored by organizations and individuals for the work of establishing and organizing the implementation of urban and rural planning.

Meanwhile, at point d, clause 4 of this Article, it is stipulated that the funds of the organization selected as the investor shall be used to make plans for the investment area. Thus, this source of funding is not included in the three sources of funding stipulated in clause 2.
Therefore, the female delegate recommended that the drafting agency study and add additional regulations in Clause 2 on investor funding to organize planning within the scope assigned as project investor.
Regarding the subjects, contents, forms and time for collecting opinions on urban and rural planning as stipulated in Article 37, delegates recommended that the drafting agency study and adjust in the direction that if opinions are collected at the task appraisal and planning appraisal levels, opinions will not be collected at the planning organization level in order to reduce procedures and speed up the progress of planning work. At the same time, the regulation on collecting opinions from the community on detailed urban and rural planning tasks should be removed.
Regarding the Appraisal Council, Ms. Huyen recommended that the drafting agency study and re-regulate in the direction that the head of the specialized agency performing the State management function of urban and rural planning at the provincial and district levels is authorized to be the Chairman of the Appraisal Council to ensure objectivity, impartiality, and transparency in the appraisal and approval of planning tasks, urban and rural planning.
Avoid overlap within the planning system
Giving his opinion at the discussion session, National Assembly Deputy Hoang Van Cuong ( Hanoi delegation) emphasized that urban planning and rural planning are two different categories but are intertwined. Therefore, the development of the Law on Urban Planning and Rural Planning is extremely necessary to have a synchronous planning system, ensuring integration, comprehensiveness, avoiding overlapping plans, and harmoniously combining urban development with rural construction.
According to Mr. Cuong, the development of this Law is also an opportunity to review the overall planning related to urban and rural areas to have a logical, hierarchical planning system; both a premise and a basis for implementing lower-level planning, and at the same time concretizing higher-level planning.

Mr. Cuong pointed out that although urban and rural planning has been screened, there are still overlaps within the planning system adjusted in this draft Law as well as the planning adjusted in the Law on Planning.
The delegate cited that according to this draft Law, the province will have a general planning for provincial cities, a general planning for towns, and a general planning for districts with the same coverage ratio for the entire space of a province.
"But then there is a general planning of functional areas. Will this planning overlap with the above planning?", Mr. Cuong wondered.
Or there is an urban zoning plan but there is a town plan with the same scale; the district's general plan and the commune's general plan are also at the same scale; how will the district's general plan and the district's regional plan be separated to avoid overlap?... Currently, there are cases where the general plan often repeats the provincial plan. Therefore, Mr. Cuong suggested that the draft Law must review and clarify this issue.
Giving her opinion, National Assembly Delegate Nguyen Thi Ngoc Xuan (Binh Duong delegation) said that, regarding the explanation of terms, it is proposed to supplement the explanation of the terms "residential unit" and "master plan" to create clarity in the process of implementing the Law.
In Article 15 on the procedures for establishing, appraising and approving urban and rural planning, Ms. Xuan proposed adding the content of collecting public opinions on urban and rural planning to comply with current laws.
In Article 46, types of urban and rural planning adjustments and adjustment principles, Ms. Xuan proposed to add content for social housing, renovation, reconstruction of apartment buildings, and on-site resettlement with preferential treatment in construction density and land use coefficient to speed up project progress and meet people's needs .
