Proposing some cases where officials should not use AI in performing official duties

The draft Law on Digital Transformation that the Ministry of Justice is reviewing clearly states very strict principles for officials, civil servants, public employees and workers in state agencies when using AI systems in public service activities.

According to the Ministry of Science and Technology (the agency drafting and submitting the bill), the issue of strictly controlling the development and application of AI, especially in the public sector, to ensure that this technology serves the sustainable development of society, while protecting the rights and legitimate interests of people and businesses, must "comply with the law on digital technology , safety, network security, personal data security, ensure respect for human rights, be in accordance with good customs and social ethics and not negatively affect the reputation and operations of agencies and organizations".

The draft clearly lists prohibited acts related to AI in digital transformation, aiming to protect people and organizations from the potential risks of this technology.

Specifically, cadres, civil servants, public employees and workers in state agencies in the political system are prohibited from using AI systems for the following acts: using AI to process information in the list of state secrets; using personal data without the consent of the subject; using internal information that may affect national security and social order and safety; committing acts that violate the law (such as fraud, creating false information, destroying information systems, or illegally interfering with information systems).

Storing official passwords on AI devices or systems, or exploiting AI information in public places in a way that could expose information, are also prohibited.

In addition, the draft also clearly stipulates citizens' rights in the digital society, including the right to choose, the right to decide on the use of digital services, the right to know, explain and intervene in automated decisions of algorithms that affect legitimate rights and interests.

The draft also prohibits unfair competition practices by digital platforms with dominant market positions, such as unfair pricing, discrimination, and prioritizing platform products and services to suppress other businesses, creating a fair playing field for businesses.
