According to the Ministry of Science and Technology (the agency that drafted and submitted the bill), the issue of strictly controlling the development and application of AI, especially in the public sector, to ensure that this technology serves the sustainable development of society, while protecting the legitimate rights and interests of citizens and businesses, must "comply with laws on digital technology , cybersecurity, personal data security, ensure respect for human rights, be consistent with customs and traditions, social ethics, and not negatively affect the reputation and operations of agencies and organizations."

The draft clearly lists prohibited behaviors related to AI in digital transformation, aiming to protect individuals and organizations from the potential risks of this technology.

Specifically, officials, civil servants, and employees in state agencies within the political system are prohibited from using AI systems for the following actions: using AI to process information classified as state secrets; using personal data without the subject's consent; using internal information that may affect national security or social order; and committing illegal acts (such as fraud, creating false information, disrupting information systems, or illegally interfering with information systems).

Storing official passwords on AI devices or systems, or exploiting AI information in public places in a way that could expose information, are also strictly prohibited.

In addition, the draft also clearly defines the rights of citizens in the digital society, including the right to choose, the right to decide on the use of digital services, the right to know, to have explanations, and to intervene in automated algorithmic decisions that affect their legitimate rights and interests.

The draft also prohibits unfair competitive practices by dominant digital platforms, such as unfair pricing, discrimination, and prioritizing the platform's products and services to suppress other businesses, thereby creating a level playing field for all businesses.
