On the morning of October 31, at Discussion Group No. 16, including National Assembly deputies from Da Nang, Cao Bang and Tuyen Quang provinces, the deputies discussed the draft Law amending and supplementing a number of articles of the Law on International Treaties; the Law amending and supplementing a number of articles of the Law on Industry, National Defense, Security and Industrial Mobilization.

Speaking at the discussion on the draft Law on Industry, National Defense, Security and Industrial Mobilization, comrade Ma Thi Thuy, member of the Provincial Party Committee, Deputy Head of the Provincial National Assembly Delegation, said that the draft stipulates incentives and support but is not clear about the criteria, scope and order of priority. The delegate suggested that the drafting committee specify and clearly define the principle of giving priority first to enterprises and organizations directly performing the tasks of research, production, repair, maintenance and supply of security products and services. Next are scientific and technological organizations, capable civil enterprises participating in cooperation in the field of security industry; localities, educational and technical training establishments participating in the development of human resources and infrastructure serving the security industry.

Regarding the Security Industry Development Management Council, delegates affirmed that the establishment of this Council is necessary to strengthen the coordination, consultation and coordination mechanism for security industry development activities between ministries, branches, localities and enterprises. It is recommended that the draft clarify the legal position, functions, tasks, powers as well as the relationship of the Council with the agency in charge of security industry such as the Ministry of Public Security . At the same time, the Drafting Committee needs to clearly define the nature of this Council as an advisory, inter-sectoral coordination agency or an executive management agency. Specifically define the responsibilities between the Council and the agency in charge of security industry, avoiding duplication of functions... In the process of perfecting the law, it is necessary to carefully evaluate similar organizational models currently operating in the defense industry sector, so that they can inherit and adjust them to suit the characteristics of the security industry.

Delegate Lo Thi Viet Ha also agreed with the proposal to separate the national industrial fund and the security industry fund, but it is necessary to add regulations on supervising the fund's operations; the tasks of these two funds must be equivalent.

Regarding the National Security Industry Development Management Council, delegates said that the draft is still general and suggested that the drafting agency provide principled regulations in the draft law.

Delegate Trang A Duong of Tuyen Quang delegation proposed to review the expression of "National security industrial complex" (Article 45a) to ensure consistency with current law. The delegate said that it is not necessary to stipulate the role of "leading and orienting the State" in this article, because the Prime Minister has established a State Steering Committee on this field. He also suggested adding the phrase "suitable to needs" when regulating organizations and enterprises other than the People's Public Security participating in the complex, avoiding overly broad regulations.

Delegate Vuong Thi Huong contributed many contents to the Law amending and supplementing a number of articles of the Law on International Treaties. In Article 21 (Assessment records), it is proposed to add mandatory documents for treaties related to criminal, procedural or human rights, including: Report on assessing compatibility with the Constitution, the Penal Code; Report on assessing the impact on human rights; and appraisal opinions of the Supreme People's Procuracy.

Article 58 (Archive): Delegates proposed to add a provision that the storage of records and documents of international treaties must comply with the "Law on Protection of State Secrets" in addition to the law on archives, due to the sensitive nature of many treaties. Article 60 (Posting): It is proposed to clarify which cases are "required not to post" (For example: related to state secrets, national defense) to avoid arbitrary application and increase transparency.

Article 72a (Authorization in special cases): Delegates agreed to add regulations but requested clarification of the procedure for collecting opinions (the Ministry of Justice conducts legal appraisal first, then the Ministry of Foreign Affairs and other agencies). At the same time, it is necessary to specify the scope and duration of authorization, instead of "a specified period of time" which is still general.

Regarding transitional provisions: Delegates proposed to add regulations on handling of dossiers "in the process of preparation" or "approved in principle" but not yet submitted, instead of only regulating for "submitted" dossiers to avoid procedural congestion.
