The Ministry of Justice's interdisciplinary inspection team worked with the Provincial People's Committee

On December 18, the Ministry of Justice's Interdisciplinary Inspection Team led by Mr. Dang Hoang Oanh, Deputy Minister of Justice, had a working session with the Provincial People's Committee on inspection, review, and systematization of legal documents (VBQPPL). Mr. Phan Tan Canh, member of the Provincial Party Committee, Vice Chairman of the Provincial People's Committee received and worked with the team.

According to the report of the Provincial People's Committee, from January 1, 2021 to June 30, 2023, the Provincial People's Committee issued 219 legal documents and self-checked 219/219 documents. Of these, 3 documents were found to have illegal content, 8 documents were found to have errors in legal basis, validity, format, and document presentation techniques. The Provincial People's Committee handled the matter by issuing correction decisions; inspected documents according to authority, through the Department of Justice, received 54 legal documents sent by the District People's Committees and issued them with the correct authority and procedures according to regulations. Regarding the document review, there are 159 documents that must be implemented by the Provincial People's Council and People's Committee, of which 159/159 documents have been implemented; the total number of documents that need to be processed is 176 documents. Up to now, the province has processed, amended, supplemented, replaced or abolished 176 reviewed documents... In implementing the announcement of the List of Legal Documents that have expired or ceased to be effective according to regulations, the Provincial People's Committee has issued 124 documents that have expired or ceased to be effective in their entirety; 46 documents that have expired or ceased to be effective in part...

Speaking at the inspection session, Mr. Phan Tan Canh, Vice Chairman of the Provincial People's Committee, acknowledged the opinions of the Inspection Team on the issues discovered through the inspection of documents issued by the Provincial People's Council and People's Committee, initially showing signs of non-compliance with legal regulations, including 23 documents. In order for the legal documents issued by the Provincial People's Council and People's Committee to ensure consistency, synchronization, and suitability, in the coming time, the Provincial People's Committee will continue to direct the agencies assigned to preside over advising on the drafting of resolutions and decisions of the Provincial People's Council and People's Committee to strictly implement them, in accordance with the order, procedures, and authority prescribed by the Law on Promulgation of Legal Documents 2015, the Law on Amending and Supplementing the Law on Promulgation of Legal Documents and documents guiding their implementation...

In his concluding remarks at the inspection, Mr. Dang Hoang Oanh, Deputy Minister of Justice, highly appreciated the direction and administration of the Provincial People's Committee in the timely inspection, handling, review and systematization of legal documents. He requested the Provincial People's Council and People's Committee to continue to direct the effective and serious implementation of the Law on Promulgation of Legal Documents and Decree No. 34/2016/ND-CP. Strengthen supervision of compliance with the Constitution and laws in the activities of building, inspecting, handling, reviewing and systematizing legal documents in the province; direct the Committees of the Provincial People's Council to proactively coordinate with relevant agencies in the process of building, examining and promulgating legal documents. For the Provincial People's Committee, promptly handle the documents issued by the Provincial People's Committee as stated in the conclusion for the Ministry of Justice within 30 days from the date of receiving the conclusion; Assess the consequences and impacts of the document and consider and handle the responsibility of those who issued or advised on the issuance of illegal documents according to regulations. Timely and fully review legal documents according to the provisions of the Law on Promulgation of Legal Documents 2015 (amended and supplemented in 2020) and Decree No. 34/2016/ND-CP (amended and supplemented by Decree No. 154/2020/ND-CP); improve the quality and effectiveness of coordination between the Department of Justice and departments and branches in drafting, promulgating, checking, handling, reviewing and systematizing legal documents.

According to the report, from 2021 to June 2023, the work of inspecting, reviewing and systematizing legal documents of the People's Council and People's Committee in Ninh Thuan province has been well implemented by agencies, units and localities. The People's Committee issued Plan No. 357/KH-UBND dated February 6, 2023 on Systematizing legal documents for the 2019-2023 term in the province and documents for implementation.
