The document clearly stated that, implementing the 2-level local government model, a number of new regulations on construction licensing, exemption from construction licensing and construction order management have been issued to serve as a basis for managing construction investment activities. However, the understanding of regulations and implementation in some localities and some investors are still unclear, incorrect and incomplete, especially the contents related to construction order management and the announcement of areas exempted from construction permits.

In order to effectively manage construction order, at the same time make administrative procedures transparent and create initiative for people and businesses in implementing construction procedures and processes for granting and exempting construction permits according to the Law, the Department of Construction requests the People's Committees of communes and wards to issue permits according to their authority and review and publicly announce projects and areas that meet the conditions for exemption from construction permits in the area.
According to regulations and instructions, the People's Committee at the commune level has the authority to grant construction permits for level III, level IV works and individual houses in the area under its management. Cases exempted from construction permits include: Works belonging to construction investment projects that have been appraised by specialized construction agencies; Feasibility study reports on construction investment in areas with detailed planning at a scale of 1/500 or urban designs approved by competent authorities; level IV construction works, individual houses in rural areas with a scale of less than 7 floors and located in areas without urban planning, functional area planning or detailed planning of construction areas determined in the general district planning, general commune planning approved by competent state agencies; level IV construction works, individual houses in mountainous areas, islands in areas without urban planning, functional area planning; Except for individual buildings and houses built in conservation areas, historical and cultural relic sites, etc.
Based on the above regulations, the Department of Construction requests the People's Committees at the commune level to organize a review of projects, especially the provisions on: Construction level, setback (if any), construction area, total floor area, building height, number of floors, color, architectural form... in construction planning projects, urban designs approved by competent authorities to serve as a basis for public announcement of projects and areas exempted from construction permits.
The announcement of projects and areas exempted from construction permits can be carried out in batches and stages, ensuring convenience in monitoring and looking up information, meeting the requirements of construction order management in the area. Along with that, strengthen the management of construction order, especially for individual housing construction projects, housing combined with production, business and services; quickly shift the management method from the "pre-inspection" model to the "post-inspection" model and focus on managing construction order after the project is announced to start construction.
