The official document states that, in implementing the two-tiered local government model, several new regulations on construction permits, exemptions from construction permits, and construction order management have been issued to serve as a basis for managing construction investment activities. However, understanding and implementing these regulations in some localities and by some investors remains unclear, incorrect, and incomplete, especially regarding the management of construction order and the announcement of areas exempt from construction permits.

To effectively manage construction order, while simultaneously increasing transparency in administrative procedures and empowering citizens and businesses to proactively implement construction procedures regarding permits and exemptions from construction permits as stipulated by law, the Department of Construction requests the People's Committees of communes and wards to issue permits within their authority and to review and publicly announce projects and areas that meet the conditions for exemption from construction permits in their respective areas.
According to regulations and guidelines, the People's Committee at the commune level has the authority to issue construction permits for Class III and Class IV constructions and individual houses within its jurisdiction. Cases exempt from construction permits include: Construction projects that have had their feasibility study reports appraised by specialized construction agencies in areas with detailed planning at a scale of 1/500 or urban design approved by competent authorities; Class IV constructions and individual houses in rural areas with a scale of less than 7 floors and located in areas without urban planning, functional zone planning, or detailed construction zone planning as defined in the district or commune general planning approved by competent state agencies; Class IV constructions and individual houses in mountainous and island areas located in areas without urban planning or functional zone construction planning. excluding buildings and individual houses constructed within conservation areas, historical and cultural relic sites, etc.
Based on the above regulations, the Department of Construction proposes that the People's Committees of communes organize a review of projects, especially regarding regulations on: building elevation, setbacks (if any), construction area, total floor area, building height, number of floors, color, architectural style, etc., in construction planning and urban design projects approved by competent authorities, in order to publicly announce projects and areas exempt from construction permits.
The announcement of projects and areas exempt from construction permits can be carried out in stages, ensuring convenience in monitoring and searching for information, and meeting the requirements of managing construction order in the area. Along with this, strengthen the management of construction order, especially for individual houses and houses combined with production, business, and service activities; quickly shift the management method from a "pre-inspection" model to a "post-inspection" model and focus on managing construction order after the project is announced to commence.
