Draft Law on Disease Prevention (amended): Good disease prevention will bring great benefits

On the afternoon of November 10, under the leadership of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly worked in the Hall, discussing the draft Law on Disease Prevention (amended) and the draft Law on Population.

It is necessary to organize preventive medicine synchronously from central to local levels.

Agreeing with the need to develop a draft Law on Disease Prevention (amended), National Assembly Deputy Tran Khanh Thu ( Hung Yen ) also acknowledged that the drafting agency had a report on acceptance, explanation and revision of the draft Law in quite detail and complete. In particular, the draft Law has added Article 27 regulating periodic health examinations and screening, demonstrating the spirit of "prevention first", in accordance with the principles of the International Health Regulations.

The delegate also pointed out the reality that the organizational structure of grassroots health care and preventive medicine has changed a lot, is not unified, and there is no close coordination mechanism between health care - government - community, causing the disease prevention system to operate in a fragmented manner, lacking initiative and overall strength.

Therefore, delegate Tran Khanh Thu proposed adding 1 article to regulate the unified preventive health organization model, synchronized from central to local levels.

In particular, clarify the role and responsibility of the health station when it is under the management of the People's Committee of the commune or ward, and how is the interconnection system between the province and the commune when it is necessary to transfer human resources in two directions? Professional operations need a unified coordination mechanism along the vertical sector, with the participation of the government but ensuring the professionalism and discipline of the health system.

Regarding disease prevention nutrition, the draft Law has added 3 articles with contents on nutrition for children, workers and the elderly to ensure the application of nutritional principles in disease prevention according to the life cycle.

However, according to delegate Tran Khanh Thu, the current provisions of the draft Law are not really complete, it is proposed to add Clause 2, Article 34. Accordingly, it stipulates that "All people have the right to fair access to nutrition and food to achieve optimal nutritional status, contributing to improving health; implementing appropriate nutrition to improve nutritional status suitable for each subject, locality, region, area, and ethnicity, contributing to reducing the burden of disease, improving the stature, physical strength and intelligence of Vietnamese people".

Along with that, it is necessary to amend the provisions in Clause 1, Article 34. Instead of "focusing on nutrition in the first 1,000 days of life from pregnancy until the child is 24 months old", the delegate said that nutrition in disease prevention must be implemented throughout the life cycle, according to each age group, each subject on the basis of assessing nutritional status and meeting nutritional needs, preventing and combating malnutrition and controlling risk factors affecting health related to nutrition. In which, the focus will be on nutrition in the first 1,000 days of life from pregnancy until the child is 24 months old.

Delegate Tran Khanh Thu also noted that the nutritional regimens used for patients in hospitals not only support treatment with medication but also prevent disease progression or complications such as those for diabetics, kidney patients, cardiovascular patients, etc.

Therefore, the delegate proposed to supplement the regulation that Nutrition at medical facilities must be implemented for patients with a diet appropriate to their nutritional status and medical condition to prevent malnutrition, control and prevent the risk of complications and severe disease progression related to nutrition.

The delegate also proposed to consider amending and supplementing Point d, Clause 1, Article 21, Clause 5a, Article 22 of the Law on Health Insurance in the direction of "Some disease prevention services, preventive nutrition, chronic disease management, periodic health check-ups and screening examinations according to professional requirements according to a suitable roadmap and the balancing capacity of the Health Insurance Fund".

Consider merging the Tobacco Harm Prevention Fund into the Disease Prevention Fund

Delegate Tran Khanh Thu also pointed out that the draft Law still has unclear or insufficient provisions in a number of "disease prevention" areas such as environmental medicine and climate change; occupational medicine - occupational diseases; maternal - child and adolescent health; health of the elderly - people with disabilities; injury prevention and community safety...

In particular, with respect to Environmental Health and Climate Change, the draft Law only mentions “environmental sanitation and air pollution control” scattered in Articles 3 and 9, but there are no regulations on monitoring and assessing environmental impacts on health, water, air, medical waste, climate change and ecological and climatic factors.

Therefore, delegates proposed to add a separate Chapter or at least 1 article: "Prevention of diseases caused by environmental factors and climate change" to regulate the responsibility for environmental monitoring, control of air quality, water, noise, chemicals, toxic substances and plans to adapt to climate change.

Sharing this view, National Assembly Deputy Nguyen Anh Tri (Hanoi) also said that Chapter III on Prevention and Control of Non-Communicable Diseases, Mental Health Disorders and Risk Factors is still sketchy and many contents are unclear.

In addition, delegate Nguyen Anh Tri noted that to prevent cancer, it is necessary to deploy communication so that people are aware of the risks, deploy screening, early detection of risks... Supplement more comprehensive regulations on preventing congenital and genetic diseases by clearly stating the implementation of measures such as: disease communication, testing, disease gene detection, detection of congenital and genetic diseases in many specialties... Because, according to the delegate, professional calculations have shown that if disease prevention is implemented, it will be thousands of times more beneficial than treatment measures, especially for non-communicable and genetic diseases.

Regarding the conditions for ensuring disease prevention (Chapter V), the National Assembly deputies agreed with the need to regulate the Disease Prevention Fund, including regulations on the source of the fund in the draft Law. However, delegate Nguyen Anh Tri suggested that it is necessary to consider merging the Tobacco Harm Prevention Fund into the General Disease Prevention Fund.

Because, according to the delegate, the work of preventing and combating traditional cigarettes is not really good, while now many new types of cigarettes have emerged, this fight is still extremely fierce. "If the work of preventing and combating the harmful effects of cigarettes does not have a separate fund to do it more thoroughly and drastically, the fragile results we have achieved over the past 10 years will be lost," the delegate noted.

On the other hand, delegate Nguyen Anh Tri also proposed the need to research and supplement regulations on measures, content, and funding sources for digital transformation in hospital rooms.

“How can a person with an epidemic disease enter Vietnam and be known everywhere? A disease gene that sneaks into a family line is tracked to be destroyed. Vaccination for the community, for individuals... all need to be monitored and require a large budget. Therefore, it needs to be done in a rolling and prioritized manner,” said the delegate.
