According to Article 58 of the 2008 Road Traffic Law, drivers participating in traffic must be of the required age and health, possess a driver's license issued by a competent state agency, and must carry the following vehicle documents:
- Vehicle registration;
- Driver's license;
- Certificate of technical safety and environmental protection inspection for certain types of vehicles;
- Motor vehicle liability insurance certificate.
The documents that people carry when driving a vehicle must be original documents issued by competent state agencies, appropriate for the type of vehicle they are driving, and still valid. Photocopies or printed copies (including notarized copies) are not accepted.
Using a notarized photocopy of a driver's license may result in penalties as stipulated in Article 21 of Decree 100/2019/ND-CP dated December 30, 2019, which regulates administrative penalties for violations in the field of road and rail transport.
The fine for motorcycles is 100,000 - 200,000 VND, and for cars it is 200,000 - 400,000 VND.
However, drivers are allowed to use a certified copy of the vehicle registration certificate along with the original receipt from the credit institution that is still valid, instead of the original vehicle registration certificate, while the credit institution holds the original certificate.
Specifically, Clause 13, Article 80 of Decree 100/2019/ND-CP stipulates: “Drivers of vehicles participating in traffic may use a certified copy of the Vehicle Registration Certificate (for road vehicles), a certified copy of the Railway Vehicle Registration Certificate (for railway vehicles) accompanied by the original valid receipt from the credit institution, instead of the original Vehicle Registration Certificate or Railway Vehicle Registration Certificate during the period the credit institution holds the original Vehicle Registration Certificate or Railway Vehicle Registration Certificate.”
Accordingly, in cases where a vehicle is purchased on an installment plan from a bank or credit institution that holds the original vehicle registration certificate as collateral for civil obligations (mortgage, installment purchase, etc.), the vehicle owner may use a certified copy with the bank's signature on their vehicle registration certificate when participating in traffic.
Please note that when driving, drivers must carry the original, valid receipt from the credit institution to avoid penalties.
Therefore, in the case of a vehicle purchased on an installment plan, even though the bank holds the vehicle registration certificate, the driver is still allowed to carry a notarized photocopy bearing the bank's official stamp, which is in accordance with regulations.
