Assign the Ministry of Home Affairs to urgently submit to the Government a draft Decree on piloting decentralization to Ho Chi Minh City.

The Draft Decree has been approved by the majority of Government members.

The Government Office has document No. 302/TB-VPCP announcing the conclusion of the Government Standing Committee giving opinions on the draft Decree on piloting decentralization of state management in a number of areas to the Ho Chi Minh City government.

Accordingly, the Government Standing Committee believes that the development and promulgation of a Decree on piloting the decentralization of state management in a number of areas to the Ho Chi Minh City government to promulgate mechanisms and policies in accordance with its authority to adjust and supplement appropriate regulations to resolve shortcomings arising in the practice of management and development of the City in the spirit of Resolution No. 98/2023/QH15 dated June 24, 2023 of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City.

The draft Decree has been approved by the majority of Government members. In principle, the draft Decree has met the conditions for signing and promulgation.

The Government Standing Committee agreed to approve 04 contents with different opinions according to the report of the Government Office.

Things to note

In particular, the Government Standing Committee noted that, regarding the pilot content of decentralization to the City government to issue the List of preferential industries and occupations in the investment sector: research and complete the draft Decree in the direction of assigning the City People's Committee to consult with the Ministry of Planning and Investment before submitting to the People's Council for decision on the List of preferential industries and occupations in the investment sector in the City.

Regarding the pilot content of decentralization of training, training, business travel, conference, and reception expenses and the pilot content of decentralization of auction organization for leasing of production and business premises and real estate facilities subject to the regulation of Decree No. 167/2017/ND-CP dated December 31, 2017 regulating the arrangement and handling of public assets: study and complete the draft Decree in the direction of assigning the City People's Committee to consult with the Ministry of Finance before submitting it to the City People's Council for decision.

Supplementing regulations on the abolition of Decree No. 93/2001/ND-CP dated December 12, 2001 on decentralization of management of a number of fields to Ho Chi Minh City; in case there are regulations different from those in the Decree, this Decree shall apply.

The Government Standing Committee assigned the Ministry of Home Affairs to urgently complete the draft Decree and submit it to the Government before July 8, 2024.

The Government Standing Committee assigned Deputy Prime Minister Tran Luu Quang to review and sign the Decree.
