Our Party's consistent policy is to thoroughly grasp and practice the viewpoint "People are the root"; to determine that building and perfecting the Socialist rule of law State of Vietnam of the people, by the people and for the people under the leadership of the Party is the central task of renewing the political system. The political report and summary of a number of theoretical and practical issues over 40 years of renewal presented to the 14th National Party Congress clearly stated: to build the organization and operation of the apparatus of the Socialist rule of law State of Vietnam, the Party affirmed the policy of continuing to renew the organization and operation of the State apparatus; to carry out state administrative reform; to distinguish and improve the quality of the contingent of cadres with civil servants and public employees; to renew from the mindset of "The State does everything" to the mindset of diversifying economic entities, reducing state monopoly, and eliminating business monopoly .

This is a new development in theoretical awareness that is of interest to many party members and the people. Please contribute your comments and clarify some issues of awareness from practice.
First of all, about the awareness of building the organization and operation of the apparatus of the Socialist Republic of Vietnam. The rule of law as a doctrine born in ancient times, has the most progressive value, and has been developed by mankind until today. The core of the doctrine of the rule of law is to protect human rights, to protect the freedom of individuals. In the history of our country's revolution, that core value was expressed in the Declaration of Independence of the Democratic Republic of Vietnam, solemnly declared by President Ho Chi Minh to the world and the people on September 2, 1945: "All men are born equal. Their Creator gives them certain inviolable rights; among these rights are the right to life, the right to liberty, and the right to pursue happiness."
The Socialist Republic of Vietnam follows the model of a rule-of-law state, inheriting and constantly transforming the values of the rule-of-law state doctrine into practical life, all state power belongs to the people. President Ho Chi Minh once advised: "Today, we have built the Democratic Republic of Vietnam. But if the country is independent but the people do not enjoy happiness and freedom, then independence is meaningless." Our Party firmly believes in the goal of building and perfecting the rule-of-law socialist state of Vietnam, which is to make the people enjoy happiness and freedom.
Second, on continuing to innovate the organization and operation of the state apparatus; reforming state administration (institutions, apparatus, public assets, people). In the context that the entire political system under the leadership of the Party is urgently implementing the revolution of streamlining the apparatus organization, implementing the 2-level local government model, the whole country still has 34 provinces and cities, the regional economic structure has changed... Therefore, the document needs to clarify the issue of establishing a new, sustainable growth model of localities towards the common goal of the whole country which is to fight waste of public assets, improve productivity, quality, efficiency of the administrative system, added value and competitiveness of the economy. On the other hand, it is necessary to focus on the growth pole role of medium and small cities in the provinces in the new growth model to make the most of the country's potential resources.
Third, clarify the orientation, distinction and improvement of the quality of the staff with civil servants and public employees in the organization and operation of the apparatus of the Socialist Republic of Vietnam. Clarify whether there is any confusion between "academic human resources" and "public administrative human resources" when each locality issues policies to attract high-quality human resources, some places spend hundreds of millions to billions of dong in the budget for each person with a professor or doctorate degree in science to work at local state administrative agencies? Some places also have policies to spend budget to train cadres and civil servants to become PhDs so they can work as "desks"? High-quality human resources in the state apparatus are very necessary, but there needs to be a clear orientation to avoid wasting the intelligence and tax money of the people.
Fourth, on innovation from the mindset of "the State does everything" to the mindset of diversifying economic entities, reducing state monopoly, and eliminating enterprise monopoly . This is a new development in thinking, quickly shifting from "issuing policies" to "executive governance" in the spirit of General Secretary To Lam's direction at the Conference to disseminate and implement Resolution 59 and 3 resolutions 70-71-72 of the Politburo; in accordance with the law of development, clarifying and promoting the State's service role in the market economy.
In the context of implementing a two-level local government, it is necessary to strongly shift from the current traditional administrative model to a new model of development administration and public administration. This model has the advantage of flexibility, clearly distinguishing the scope of "public affairs", "Public Administration", and "Public Services". Accordingly, "Public Affairs" under the state power cannot be delegated to other areas such as: national defense, national security, social order and security, ensuring sustainable development, social security, equality of enjoyment; and use of the state budget.
''Public administration'' is a public service activity, but some activities are purely professional and supportive in nature and can be delegated to other organizations that are not part of the state sector. ''Public services'' are activities that meet the essential material and spiritual needs of the people; they are the responsibility of the state but can be delegated (socialized, privatized). Therefore, they can be performed by state organizations, private organizations or individuals if they do better.
Implementing a two-level local government, strongly shifting from the mindset of "the State does everything" to a diversified mindset, once the goals have been set, the issue is not who does it, but how to achieve the goals with the highest efficiency and the most satisfaction for the people.
In many countries, in the field of public service provision - which is the domain of the State, people organize bidding, transfer the majority of education, training and health care... to the system of signing contracts with entities outside the state sector, creating a vibrant socialization trend, limiting bureaucracy, negativity, corruption and better meeting the needs of the people, bringing a new breath of life to the state apparatus, welcomed by the people.
