Perfecting regulations on urban and rural planning system

The Draft Law consists of 6 chapters and 65 articles.

After 14 years of implementing the Law on Urban Planning and 9 years of implementing the Law on Construction, along with new requirements of development practices, limitations and inadequacies have been revealed, which need to be studied, revised, supplemented and improved. Therefore, the development of the Draft Law on Urban Planning and Rural Planning is necessary.

The Draft Law consists of 6 chapters and 65 articles, closely following and clearly demonstrating 3 groups of policies that have been approved, including: perfecting regulations on the urban and rural planning system; perfecting regulations on the establishment, appraisal, approval, review and adjustment of urban and rural planning; perfecting regulations on the selection of planning consultancy organizations, funding sources and other relevant regulations to improve the quality and feasibility of urban and rural planning; the right to access and provide information on urban and rural planning.

Inheriting the scope of regulation of the 2009 Law on Urban Planning and the 2014 Law on Construction (Chapter II), on the basis of the scope of urban and rural planning stipulated in the 2017 Law on Planning, the scope of regulation of the proposed Law is: "This Law regulates the urban and rural planning system; establishment, appraisal, approval, review, adjustment, organization and management of urban and rural planning and state management of urban and rural planning".

Ensuring close connection between urban and rural planning

In his report on the review of the Law Project, Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that the Economic Committee basically agreed with the necessity of promulgating the Law. However, the Economic Committee suggested that it is necessary to clarify the relationship between types of planning in the urban and rural planning system, the relationship with planning in the national planning system and specialized technical planning, principles, bases for establishing and adjusting planning.

At the same time, it is necessary to decentralize and delegate power in the establishment, appraisal, approval, adjustment and management of urban and rural planning to enhance the role, initiative and responsibility of local authorities in accordance with their capacity and resources for implementation; reduce administrative procedures in the establishment, appraisal, approval and adjustment of urban and rural planning, meeting the requirements of improving the investment and business environment.

According to Chairman of the Economic Committee Vu Hong Thanh, it is necessary to review and clearly define the scope and objects, ensuring close connection between urban planning and rural planning.

According to Chairman of the Economic Committee Vu Hong Thanh, many opinions agreed with the scope of adjustment (Article 1) of the draft Law; at the same time, it was suggested to continue researching and reviewing the content of basic concepts such as "urban" and "rural", ensuring the orientation of connection between urban and rural areas and in accordance with the reality of the interweaving between urban and rural areas.
