(HNMO) - On May 29, the Investigation Police Agency, Dong Nai Provincial Police decided to initiate a criminal case to investigate the crime of "Abusing position and power while performing official duties" occurring at the Tan Thinh residential area project (Doi 61 commune, Trang Bom district, Dong Nai province) invested by LDG Investment Joint Stock Company (LDG Company).
This is a case that the Central Steering Committee on Anti-Corruption and Negativity has put under monitoring and direction.
Previously, Dong Nai Provincial People's Committee issued Inspection Conclusion No. 01/KT-UBND on the comprehensive inspection of Tan Thinh residential area project, Doi 61 commune, Trang Bom district. Tan Thinh residential area project has an area of over 18 hectares, approved by the Provincial People's Committee for investment policy and location introduction in 2016, planned for residential land purposes for the period 2011-2020 and transition to 2030. On November 22, 2018, the Provincial People's Committee issued a decision approving the policy for LDG Company to invest in the construction of Tan Thinh residential area project in Doi 61 commune.
The land area of the project originated from 402 plots of land of An Vieng Rubber Farm and households and individuals. Of these, 339 plots were granted land use right certificates to 26 households, individuals and LDG Company with an area of over 15 hectares. LDG Company used the land plots through the forms of receiving land use right transfer, receiving land use authorization and transferring land by handwritten papers, which are not in accordance with the law.
After the Dong Nai Provincial People's Committee approved the project investment policy, LDG Company has not reported the project implementation status as prescribed, and has not completed the procedures to submit to the Department of Construction for construction permits for technical infrastructure works, medical stations, commercial service areas andeducation . As for individual housing projects, the investor has not provided legal documents on land to grant construction permits and has not announced the time of construction commencement, along with construction design documents as prescribed.
The review and statistics of rice-growing land area within the project boundary were incorrect, from determining 6.34 hectares, while in reality it was 12.7 hectares of rice-growing land. This led to failure to promptly report to the competent authority to request approval to change the purpose of rice-growing land use.
At the time of inspection (June 2021), LDG Company had not been allocated land, leased land, permitted to change land use purpose by competent state agencies and had not been granted a license to invest in project construction. However, from 2018-2020, LDG Company had organized the construction of 680 houses, of which 198 villas and 290 townhouses had been completed; 192 townhouses were under construction. In addition, the traffic system, water supply and drainage, electricity, wastewater treatment, and green parks had been constructed.
While the project did not meet the conditions for future real estate to be put into business according to the provisions of the law on real estate business, LDG Company signed a contract in principle to buy and sell houses with 60 customers, for more than 132 billion VND. Of these, the company has paid 25-95% of the contract value; 7 households have moved in to live....
The above violations have signs of crime according to the provisions of Article 174, Penal Code 1999, amended and supplemented in 2009. Therefore, the Chairman of Dong Nai Provincial People's Committee directed to transfer the case file to the Investigation Police Agency, Dong Nai Provincial Police to continue to clarify and handle according to the provisions of law.
