On December 2, the Lam Dong Provincial Inspectorate concluded that the Mui Ne Resort Project (by Lam Vien Investment and Trade Services Joint Stock Company) was behind schedule, causing a risk of loss and waste; and more than 280 villas were sold against regulations.

According to the conclusion, Mui Ne resort (Mui Ne ward) is 19 months behind schedule, and will be subject to project revocation if it is 24 months behind schedule. In addition, the company is not qualified to sell future villas; but the investor has signed 281 villa purchase contracts. In addition, the company did not provide information, data, and project implementation status to the Department of Construction.

The Inspectorate also pointed out violations by relevant departments and branches. Specifically, the Department of Agriculture and Environment advised the Provincial People's Committee to issue a decision allowing the project to change the purpose of using 149,494m² from perennial crop land to non-agricultural purposes, including urban residential land, public recreation and entertainment land, and traffic land, which is not in accordance with the 2017 land use plan of the old Phan Thiet city. Along with that, the Department of Construction advised the Provincial People's Committee to allow the construction of the leveling and traffic items in advance without a construction permit, which is not in accordance with regulations.

In case the project is approved for continued investment, the Provincial Inspectorate recommends that the Provincial People's Committee direct the Department of Agriculture and Environment to coordinate with the Department of Finance and Tax of Lam Dong province to advise on a plan to handle the remaining land use fee of 238 billion VND that the investor has paid to the state budget due to the change of land use purpose.

In addition, the Department of Finance shall handle according to the provisions of law the acts of delay in project implementation; the failure to make periodic reports by the investor as prescribed; advise the province to report to the competent authority to consider allowing the investor to continue investing in the project in accordance with the prescribed legal procedures.

The departments and branches that violated this project must organize a review and handle the responsibility of the collectives and individuals under their authority for the limitations and shortcomings that occurred.
