According to the Road Traffic Law 2008, the use of headphones while driving a two-wheeled motorbike, three-wheeled motorbike, or motorbike is prohibited. Clause 3, Article 30 clearly stipulates that drivers of these vehicles are not allowed to use audio devices, except hearing aids, to ensure concentration and safety when participating in traffic.

Below are the regulations and penalties related to wearing headphones while driving a motorbike according to the Road Traffic Law and guiding decrees.
1. Penalty for wearing headphones while driving a motorbike
According to Clause 3, Article 30 of the 2008 Road Traffic Law, drivers of two-wheeled motorbikes, three-wheeled motorbikes, and motorbikes are not allowed to use audio devices such as headphones while participating in traffic. This is to ensure maximum concentration and safety for the driver, because headphones can reduce the ability to perceive sounds from the surrounding environment, endangering the recognition of traffic situations.
According to Article 31 of the Road Traffic Law 2008, regulations on the use of headphones also apply to cyclists. However, there is currently no regulation prohibiting the wearing of headphones while driving a car.
According to Point h Clause 4 Article 6 of Decree 100/2019/ND-CP, amended by Point g Clause 34 Article 2 of Decree 123/2021/ND-CP, the act of using headphones while driving a motorbike can be fined from VND 600,000 to VND 1,000,000. This fine applies to the act of using umbrellas, mobile phones, audio devices, except hearing aids.
2. Penalty for wearing headphones on one side
Even if you only wear headphones on one side, this behavior is still considered a violation of traffic regulations. According to Clause 3, Article 30 of the Road Traffic Law 2008, the use of headphones, even on one side, is still prohibited when driving a motorbike. Wearing headphones on one side does not reduce the violation and can still be punished according to regulations.
3. Driver's license revocation
In addition to being fined, motorcyclists who violate regulations on the use of headphones may also have their driving licenses revoked. According to Clause 10, Article 6 of Decree 100/2019/ND-CP, as amended by Clause 34, Article 2 of Decree 123/2021/ND-CP, additional penalties may include:
- Driver's license revocation from 01 month to 03 months if violating regulations on driving motorbikes.
- Driver's license revocation from 02 to 04 months for more serious violations, or from 03 to 05 months for causing traffic accidents.
These regulations are intended to increase seriousness in compliance with traffic rules and ensure safety for oneself and the community. The suspension of the right to use a driving license is a measure to emphasize the importance of concentration and compliance with traffic regulations.
