Removing bottlenecks in private economic development
At the 45th session of the National Assembly Standing Committee on the afternoon of May 14, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly on a number of special mechanisms and policies for private economic development.
At the meeting, Deputy Minister of Finance Nguyen Duc Tam briefly presented the report.
The report clearly stated that ensuring the full and timely institutionalization of the guidelines, viewpoints, mechanisms and policies in Resolution No. 68-NQ/TW is of a superior nature, removing bottlenecks in private economic development; and can be deployed, applied and promoted effectively in practice.
Prescribe special mechanisms and policies for private economic development to mobilize and diversify resources and free up social resources to focus on rapidly developing socio-economic infrastructure, meeting the requirements of double-digit economic growth in the next period.
The draft also clearly states the principles of inspection, examination, licensing and certification activities for enterprises, business households and business individuals.
This is to improve the effectiveness of inspection and examination work, overcome the situation of overlapping and duplication of inspection and examination, and strongly shift from pre-inspection to post-inspection.
Accordingly, each enterprise or business household cannot be inspected more than once a year, except in cases where there is clear evidence of violations.
Strictly handle acts of abusing inspection and examination to harass and cause difficulties for businesses. Prioritize remote inspection and examination based on electronic data, reduce direct inspection and examination.
Exemption from on-site inspection for enterprises that comply with legal regulations. Shifting the management of business conditions from licensing and certification to publishing business conditions and post-inspection, except for a few fields that are required to carry out licensing procedures according to international regulations and practices.
The draft also clearly distinguishes between the responsibility of legal entities and the responsibility of individuals; between criminal responsibility and administrative responsibility, civil responsibility; between administrative responsibility and civil responsibility.
For violations and civil and economic cases, priority is given to applying civil, economic and administrative measures first; enterprises, business households and business individuals are allowed to proactively remedy violations and damages. In cases where the practical application of the law may lead to criminal prosecution or no criminal prosecution, criminal prosecution shall not be applied.

For violations that are subject to criminal prosecution, priority is given to proactive, timely and comprehensive economic remedial measures first and is an important basis for the prosecution agency to consider when deciding to initiate, investigate, prosecute, try and take further measures.
Legal regulations must not be applied retroactively to deal with disadvantages for businesses, business households, and business individuals.
In cases where information, documents and evidence are not clear enough to conclude that there is a violation of the law, a conclusion must be reached promptly in accordance with the provisions of procedural law and this conclusion must be publicly announced.
Ensure the principle of presumption of innocence in the process of investigation, prosecution and trial of cases.
On schedule to pass the Resolution this weekend
Appreciating the fact that the draft Resolution was completed just 10 days after Resolution No. 68-NQ/TW was issued, National Assembly Chairman Tran Thanh Man said that the drafting agency had worked actively to meet the deadline for passing the Resolution by the end of this week.
According to Chairman Tran Thanh Man, the National Assembly will try to pass the Resolution on Saturday (May 17). This is a short resolution, with new breakthroughs in private economic development.
In addition, when amending a series of laws in the coming time, contents related to the private economy will be amended and supplemented to include in laws on criminal, civil, administrative, inspection, tax, science and technology, etc.
In order for the draft to be completed before submitting to the National Assembly, the National Assembly Chairman noted that agencies should review the contents on supporting science and technology, innovation, and digital transformation; pay attention to improving the investment and business environment, ensuring equality between domestic and foreign private enterprises.
Regarding international agreements and commitments, the National Assembly Chairman noted that it is necessary to review and avoid conflicts with international treaties and previous laws. "We need to change our thinking, the State should create instead of control, the management mindset needs to shift to creating and serving," the National Assembly Chairman requested.
In addition, the National Assembly Chairman noted that ensuring financial resources to implement policies is very important. Policies on supporting infrastructure investment; supporting land rent for high-tech enterprises, small and medium enterprises; supporting credit for start-ups, innovative enterprises; tax exemption policies for enterprises... all require huge financial resources to implement. Along with that, it is necessary to review the beneficiaries of the policies to ensure feasibility in practice.
Chairman of the Committee on Science, Technology and Environment Le Quang Huy said that priority should be given to dealing with only a few issues in the short term, and not to be ambitious in solving all of them in one Resolution. The Chairman also suggested having a monitoring mechanism to avoid risks and ensure harmony and balance.
Explaining this issue, Deputy Prime Minister Nguyen Chi Dung said that choosing which content to include in the Resolution is a very difficult issue. Regarding regulations related to criminal and civil liability, inspection, and examination, the Deputy Prime Minister said that these are major policies that the business community is looking forward to. According to the Deputy Prime Minister, if they are not included, the scope of the National Assembly's Resolution cannot be fully demonstrated. "Although it cannot be specified immediately, that is the message of the National Assembly, the direction for the implementation and amendment of the following laws," the Deputy Prime Minister said.
Concluding the session, Vice Chairman of the National Assembly Vu Hong Thanh said that the National Assembly Standing Committee highly appreciated the coordination between the Economic and Financial Committee and the Ministry of Finance. The two agencies took the initiative early and from afar to complete the draft. The National Assembly Standing Committee assessed that the draft Resolution dossier was qualified to be submitted to the National Assembly for comments tomorrow (May 15).
Before submitting to the National Assembly, the Vice Chairman of the National Assembly requested that the agencies absorb the comments at the meeting, complete the draft tonight, and send it to the National Assembly deputies tonight via the National Assembly's information app.
