Amending and supplementing a number of articles of the Regulation on decentralization of revenue sources and division ratios
Revenues and expenditure tasks for Nam Dinh province budget levels in 2022
and the 2022-2025 budget stabilization period issued with the Resolution
No. 53/2021/NQ-HDND dated December 2, 2021 of the People's Council of Nam Dinh province

Pursuant to the Law on Organization of Local Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of Government and the Law on Organization of Local Government dated November 22, 2019;
Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures for implementing the Law on Promulgation of Legal Documents; Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government amending and supplementing a number of articles of Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures for implementing the Law on Promulgation of Legal Documents; Decree No. 59/2024/ND-CP dated May 25, 2024 of the Government amending and supplementing a number of articles of Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures for implementing the Law on Promulgation of Legal Documents, which has been amended and supplemented a number of articles under Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government;
Pursuant to Resolution No. 35/2023/UBTVQH15 dated July 19, 2023 of the Standing Committee of the National Assembly on the arrangement of district and commune-level administrative units for the 2023-2030 period;
Pursuant to Resolution No. 1104/NQ-UBTVQH15 dated July 23, 2024 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units for the 2023-2025 period of Nam Dinh province;
Considering Report No. 120/TTr-UBND dated September 13, 2024 of the Provincial People's Committee on the promulgation of the Resolution of the Provincial People's Council amending and supplementing a number of articles of the Regulation on decentralization of revenue sources, the ratio of revenue sharing and expenditure tasks for Nam Dinh provincial budget levels in 2022 and the budget stabilization period 2022-2025 issued together with Resolution No. 53/2021/NQ-HDND dated December 2, 2021 of the Nam Dinh Provincial People's Council; Verification report of the Economic - Budget Committee of the Provincial People's Council; discussion opinions of the Provincial People's Council delegates at the session.
RESOLUTION:
Article 1. Amending and supplementing a number of articles of the Regulation on decentralization of revenue sources, revenue sharing ratios and expenditure tasks for Nam Dinh provincial budget levels in 2022 and the budget stabilization period 2022-2025 issued together with Resolution No. 53/2021/NQ-HDND dated December 2, 2021 of Nam Dinh Provincial People's Council:
1. Add point d, clause 6, Article 4 as follows:
“d) Regarding land use fee collection in Hung Loc ward and communes of Nam Dinh city:
- Collect land use fees when allocating land and changing land use purposes according to the annual plan approved by the Provincial People's Committee for organizations and individuals (except for land areas specified in points b and c of this clause); collect land use fees when recognizing land use rights for households that have used land: Provincial budget 50%; City budget 20%; Commune and ward budget 30%.
- Collecting land use fees from urban areas; land areas invested in infrastructure by the State (hereinafter referred to as concentrated residential areas (points); resettlement areas; revenues from land areas assigned to investors in the form of selecting investors to implement projects: Regulating the provincial budget 100%; In which, the part of the provincial budget regulation will be re-allocated to invest in projects and works in the city according to the provisions of Clause 1, Article 5 of this Regulation".
2. Amend and supplement Point a, Clause 1, Article 5 as follows:
a) Expenditure from land use fee revenue from urban areas, concentrated residential areas (points), resettlement areas; revenues from land allocated to investors in the form of selecting investors to implement projects in the wards (Cua Bac, Cua Nam, Loc Ha, Loc Hoa, Loc Vuong, Nam Phong, Nam Van, Nang Tinh, My Xa, Quang Trung, Tran Hung Dao, Truong Thi, Vi Xuyen): Re-allocate 100% of the provincial budget adjustment to spend on investment in construction of projects and works in Nam Dinh city.
For Hung Loc ward and communes of Nam Dinh city: Implement according to the provisions at points b, c, d of this clause".
Article 2. Responsibility for implementation
1. Assign the Provincial People's Committee to organize the implementation of the Resolution.
2. The Standing Committee of the People's Council, the People's Council Committees, the People's Council Delegation Groups and the Provincial People's Council delegates supervise the implementation of the Resolution.
Article 3. Implementation provisions
This Resolution comes into force from September 20, 2024.
