On April 28, the Vietnam Fatherland Front Committee of Hanoi city held a conference to provide social feedback on the draft Resolution regulating fines for a number of administrative violations in the field of environmental protection in Hanoi and the draft Resolution regulating fines for administrative violations in the field of land in the city.
Member of the Standing Committee of the City Party Committee, Chairwoman of the Vietnam Fatherland Front Committee of Hanoi City Nguyen Lan Huong attended the conference.
The draft Resolution regulating the fines for administrative violations in the field of land in the city includes 8 articles. Notably, the fine for administrative violations is twice the fine for the corresponding administrative violation prescribed in Decree No. 123/2024/ND-CP in the city, but does not exceed the fine prescribed in Article 24 of the Law on Handling of Administrative Violations. For organizations committing the same violation, the fine is twice the fine for individuals.
The draft Resolution regulating the fines for administrative violations in the field of environmental protection in the city includes 8 articles, which stipulate: The fine for administrative violations is higher than the fine for the corresponding administrative violations prescribed in Decree No. 45/2022/ND-CP in the city, but does not exceed the fine prescribed in Point k, Clause 1, Article 24 of the Law on Handling of Administrative Violations, amended and supplemented at Point k, Clause 10, Article 1 of the Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations. For organizations committing the same violation, the fine is twice the fine for individuals.
At the conference, delegates agreed on the necessity of issuing two Resolutions for implementation, contributing to effective land use and environmental protection in the capital; helping authorities at all levels to better manage and prevent violations.
Mr. Vu Thanh Vinh, member of the Advisory Council for Democracy and Law of the Vietnam Fatherland Front Committee of the city, said that increasing the fine level is only part of the solution. In order for the Resolution to come into effect, it is necessary to combineeducation and close supervision by the government and functional agencies, especially the application of fine technology.
According to Associate Professor, Dr. Vu Thi Minh, General Secretary of the Hanoi Economic Science Association, the fines for violations in the field of environmental protection are appropriate, have a deterrent effect, and educate the capital's awareness of environmental protection. However, it is necessary to specify the fine amount for each violation to increase the enforcement of this Resolution.
In addition, delegates also expressed their opinions on the need to improve law enforcement capacity; strengthen regular and unscheduled inspections and supervision in key areas; specify and clearly state the authority to impose penalties; establish a monitoring and feedback mechanism from the community; and publicize the identities of individuals and organizations violating the law on the media.
In his concluding remarks, Permanent Vice Chairman of the Vietnam Fatherland Front Committee of Hanoi Nguyen Sy Truong requested the drafting agency to study, filter and absorb the comments of experts and scientists to edit and complete the draft Resolution before submitting it to the Hanoi People's Council for promulgation.
