Late in the afternoon of July 22, after the representative of the Hanoi People's Procuracy announced more than 100 pages of the indictment, the Hanoi People's Court began questioning the defendants related to the role and purpose of Mr. Trinh Van Quyet (Chairman of the Board of Directors of FLC Group) who used Faros Company as a tool, directed subordinates to commit fraudulent acts of increasing the owner's equity at Faros Company from 1.5 billion VND to 4,300 billion VND, then completed the procedures to list shares corresponding to the value of the fictitious capital contribution of Faros Company on the stock exchange; used the Ho Chi Minh City Stock Exchange (HoSE) as a tool and means to sell 391 million shares formed from the fictitious capital contribution to 30,403 investors on the stock exchange, appropriating more than 3,621 billion VND.

Before the trial, the court requested that Mr. Trinh Van Quyet and his sister Trinh Thi Minh Hue be isolated.

The panel of judges interrogated more than 20 defendants. Most of the defendants stated that Trinh Thi Minh Hue borrowed their identity cards to open securities accounts to inflate the cash flow and that they did not benefit.

In the case, defendant Huong Tran Kieu Dung, Vice Chairman of the Board of Directors, was prosecuted for two acts of "Fraudulent appropriation of property" and "Stock market manipulation". According to the accusation, Dung knew that Trinh Thi Thuy Nga (Mr. Quyet's sister, accountant of FLC Group) allowed securities accounts in her brother's group to buy stocks when there was not enough money in the account, which was illegal, but Dung signed the minutes of the Board of Directors meeting; the Board of Directors representative signed a resolution authorizing Trinh Thi Thuy Nga to allow accounts managed by Trinh Thi Minh Hue to use to buy stocks with an amount of over 10 billion VND without illegal collateral, helping Mr. Trinh Van Quyet manipulate 3 stock codes FLC, GAB, ART, illegally profiting more than 445 billion VND.

At the investigation agency, Dung confessed as above and was paid 80 million VND/month. In court, defendant Dung said that he personally did not contribute capital to Faros Company and had been the representative of many companies at different times. The defendant had been the representative of 3 legal entities that received shares transferred from Faros Company: FLC Land Company, Khanh Hoa Real Estate Company and FLC Vinh Phuc Company.

At the time of acting as the representative of the above 3 companies to sign for the transfer of shares from Faros Company, defendant Dung said he was completely unaware of whether there was actually any business between Faros Company and the above 3 companies or not, because he was not in charge of the financial sector. Defendant Dung also affirmed that he himself did not sign the contract to receive the transfer of shares from Faros Company.

"The transfer signing only took place directly between two individuals, Mr. Nguyen Van Manh - a member of the Board of Directors of Faros Company and Ms. Pham Thanh Huong - an accountant of Sevin Company to become shareholders of Faros Company. The defendant remembers that the two people signed 5 contracts, a total of 42 million shares - equivalent to 420 billion VND", defendant Dung confessed.

Judge Vu Quang Huy asked again: "The defendant just signed the contract, right? As for the payment, the defendant doesn't know?". Defendant Dung replied: "That's right."

"The defendant is the legal representative of the companies, the defendant must know clearly, right?" - the presiding judge asked. Defendant Dung then said that at FLC Group, the defendant was assigned to the investment promotion and project development department.

"The defendant stood in the name of the above 3 companies also under the direction of Mr. Quyet to support and complete the legal procedures that the above 3 companies were implementing", defendant Dung admitted and affirmed that he did not benefit from the above work and also denied receiving 3 billion VND as stated in the indictment.

At the end of the presentation, defendant Huong Tran Kieu Dung admitted that the indictment against her for the two crimes of "Fraudulent appropriation of property" and "Stock market manipulation" was the right person and the right crime. However, the indictment assessing defendant Dung as an accomplice, actively assisting Mr. Quyet was too severe and she hoped the panel of judges would consider it.

In the indictment, defendant Trinh Thi Thuy Nga (sister of Mr. Trinh Van Quyet and older sister of defendant Trinh Thi Minh Hue) was prosecuted because her sister assigned her to sign a contract to receive investment trust from Faros Company, to legally inflate the contributed capital.

Specifically, defendant Nga signed a contract to receive investment trust from Faros Company, with a total amount of 368 billion VND to inflate the contributed capital from 1,125 billion to 3,500 billion VND; signed 50 payment authorizations to transfer more than 1,300 billion VND for defendant Hue to legalize and conceal the inflated contributed capital.

In addition, defendant Nga directly asked 3 subordinates to sign 17 contracts to receive investment trust money, with a total amount of more than 880 billion VND from Faros Company to legally inflate the contributed capital...

At the trial, defendant Nga confessed that although they were siblings, he only worked for a salary, all work was not discussed and he did not benefit from it.

Tomorrow (July 23), the People's Court will question defendant Trinh Van Quyet and the others.
