National Assembly passes Law on Identity Cards: Do people have to re-issue their CCCD cards?

The National Assembly has officially passed the Law on Identity Cards, which will take effect from July 1, 2024. The law consists of 7 chapters and 46 articles.

Accordingly, regarding transitional provisions, the newly passed Law on Identity Cards clearly states that citizen identity cards issued before the effective date of this law remain valid until the expiration date printed on the card. Citizens may exchange their old cards for new identity cards if needed.

If the national identity card is still valid, it can be used until December 31, 2024.

Legal documents that have been issued using information from national identity cards or citizen identification cards remain valid; state agencies are not allowed to request citizens to change or adjust information from their national identity cards or citizen identification cards in issued documents.

Citizen ID cards and national identity cards that expired between January 15, 2024 and before June 30, 2024 will continue to be valid until June 30, 2024.

Regulations on the use of citizen identification cards and national identity cards in legal documents issued before the effective date of this law shall be applied as to identity cards issued under the provisions of this law.

Transitional provisions

Before the National Assembly voted to approve it, on behalf of the Standing Committee of the National Assembly, Chairman of the National Defense and Security Committee Le Tan Toi presented the verification report, stating that, in response to the opinions of National Assembly deputies, the Standing Committee of the National Assembly had directed the revision and supplementation of the transitional provisions for citizen identification cards and national identity cards in Clause 3, Article 46 as follows: "Citizen identification cards and national identity cards that expire between January 15, 2024 and before June 30, 2024 shall continue to be valid until June 30, 2024."

Accordingly, Clause 2 of Article 45 is amended to stipulate the effective date as follows: "The provisions in Clause 3 of Article 46 of this Law shall take effect from January 15, 2024"; at the same time, some contents of Articles 45 and 46 are revised to ensure specificity, clarity, and suitability to reality.

The name "Identity Law" reflects its scientific and comprehensive nature.

According to Mr. Toi, some argue that there have been many changes in the form, content, and name of the identity card over time, therefore, it is suggested that the name of the law be reconsidered, and that the name of the law and the card not be changed to "identity card".

However, according to Mr. Toi, after discussion, most delegates and members of the National Assembly Standing Committee agreed with the title of the draft law and the name of the identity card that had been explained.

The Standing Committee of the National Assembly believes that using the name "Law on Identity Cards" clearly demonstrates its scientific nature, encompassing both the scope of regulation and the subjects to which the law applies, while also aligning with the trend of managing a digital society.

With the scientific integration of complete information into the identity card, along with a digital management system that ensures public accessibility, renaming it to "citizen identification card" will help make state management more scientific, serving the government's digital transformation, digital economy , and digital society.

At the same time, it facilitates and supports people's participation in social activities as well as administrative and civil transactions, making them increasingly convenient.

Mr. Toi also stated that the Party Caucus of the National Assembly had sought the opinion of the Politburo on this matter and received the Politburo's unanimous agreement on using the name "Law on Identity Cards" as presented by the Government.

The Standing Committee of the National Assembly found that adjusting the name to "Law on Identity Cards and Citizen Identification Cards" is appropriate for the purpose of managing and serving the people.
