Article 74 of the Fisheries Law stipulates the rights and obligations of crew members and people working on ships as follows:
1. Crew members and people working on fishing vessels must have the following conditions when working on fishing vessels:
a) As a Vietnamese citizen, foreigners are allowed to work on fishing vessels;
b) Have an identity card, citizen identification card, passport or other identification documents as prescribed;
c) Meet health and working age requirements;
d) Have a degree or professional certificate appropriate to the position.
2. Crew members and people working on fishing vessels have the following rights:
a) Be guaranteed labor regime, rights and legal interests when working on fishing vessels according to the provisions of labor law;
b) Refuse to work on a fishing vessel if the vessel does not meet safety requirements;
c) Be assigned to a suitable position on a fishing vessel.
3. Crew members and people working on fishing vessels have the following obligations:
a) Comply with the provisions of Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a member;
b) Comply with the captain's orders; proactively prevent accidents for yourself, crew members, people working on fishing vessels and incidents to fishing vessels;
c) Must immediately notify the captain or person on duty when discovering a dangerous situation on the fishing vessel;
d) Comply with labor laws.
The Minister of Agriculture and Rural Development prescribes titles and duties according to titles; crew size of fishing vessels; professional standards and professional certificates of crew members; crew registration and crew directory; standards for foreign crew members working on Vietnamese fishing vessels.
