
- REPORTER: Sir, how has Working Group 5013 resolved the problems of housing projects in Ho Chi Minh City to issue pink books to home buyers?
- Mr. Nguyen Toan Thang: During the course of its activities, the Working Group was able to identify the following main reasons. Firstly, during the project implementation, the Investor made planning adjustments that required it to fulfill additional financial obligations. Meanwhile, according to the provisions of the Land Law, only when the Investor fully fulfills its financial obligations will the issuance of the pink book be considered.
Second, the investor has not completed the responsibility of completing the social infrastructure of the project, which according to regulations must be completed and accepted before the issuance of the pink book can be resolved. Third, the investor has not completed the technical infrastructure, built illegally and has not yet corrected it. Fourth, the investor brought the bank mortgage certificate... During the resolution process, the Working Group requested the investor to fulfill its obligations to jointly resolve the problem.
Specifically, for the case of the investor mortgaging the certificate, the Working Group forces the investor to release the mortgage, at which point the authorities will revoke the certificate and separate the sold area and then resolve the issuance of the pink book to the buyer. For projects where the investor is late in handing over 2% of the maintenance fee to the management board, in parallel with resolving the issue of the pink book, the Working Group also requires the investor to fulfill this responsibility to protect the rights of the buyer.

- What do you think about the issue of investors holding home buyers' pink books for too long?
- Through work, the investors are very receptive and accept the issues that the Working Group analyzed and concluded. It is important to understand that, when performing its tasks, the Working Group also wants to resolve problems, not cause difficulties for investors. Accordingly, there are meetings where projects are resolved very quickly. Besides projects that can be concluded immediately, there are also projects where investors need time to complete some procedures. However, in these cases, the Working Group will resolve the issuance of pink books to the people first and continue to monitor the responsibilities of the investors until they have completed their responsibilities.
- Sir, in reality, there are investors determined to remove obstacles in issuing pink books to buyers, but there are also many investors who are still delaying the implementation of additional procedures according to the instructions of the Working Group. So, what solutions will be available to handle this?
- Currently, the Land Law and guiding decrees stipulate that if an investor incurs responsibility during the project implementation process but has not completed it, the authorities can use some tough measures. For example, investors who violate the law will not be considered for any new projects in provinces and cities across the country. At the same time, information about the investor's violations will be posted on the ministry's information page and local information page. This is with the aim of requiring investors to be responsible when selling products to people and that product must ensure quality and accompanying utilities as initially committed.

As the meeting chair, I always advise investors that if they do not fulfill their responsibilities and do not correct their violations, their information will be posted on the information pages of the authorities. At this time, investors who violate the law will have difficulty implementing new projects. It can be seen that the 2024 Land Law clearly stipulates that when allocating land, leasing land, or changing land use purposes, they must consult with provinces and cities about the operation of that investor. If there are violations, all these procedures must be stopped. However, we do not want this problem to happen, but hope that investors will join hands to solve problems and together develop the real estate market.
- Could you please tell us what the upcoming direction of the Working Group's activities will be after Ho Chi Minh City is expanded?
- Currently, Ho Chi Minh City has expanded its space to Binh Duong and Ba Ria - Vung Tau . With the responsibility of the Working Group, we will thoroughly resolve the existing problems for the projects of the expanded Ho Chi Minh City. Therefore, we have recommended that the Ho Chi Minh City People's Committee complete the apparatus as well as add members of the group to suit the new area. Recently, the Ho Chi Minh City People's Committee issued Decision 1645 to replace Decision 5013 on completing the Working Group to resolve issues related to the issuance of pink books to organizations and individuals in commercial housing development projects in Ho Chi Minh City.
Accordingly, the members of the working group, in addition to the participation of leaders of departments and branches of Ho Chi Minh City, also include leaders of the People's Committees of 168 wards, communes and special zones. In general, after basically handling the stuck projects to issue pink books to home buyers, the working group will be summarized, evaluated, drawn lessons, and terminated and will be transferred to operate according to the functions and tasks of the advisory agency for issuing the certificates.
