National training on decentralization and division of authority in the land sector when organizing two-level local government

On August 1, the Ministry of Agriculture and Environment held a national training conference on decentralization and authority assignment in the land sector when organizing two-level local governments. The conference was held in person and online to the People's Committees of provinces and cities and more than 3,400 connecting points nationwide. In Phu Tho, the conference connected to all communes and wards in the province.

Chairing at Phu Tho bridge point were comrade: Phan Trong Tan - Member of Provincial Party Committee, Vice Chairman of Provincial People's Committee; leaders of a number of departments, branches and units of the province.

Deputy Minister of Agriculture and Environment Le Minh Ngan chaired the national training conference on decentralization, delegation of power, and determination of authority in the land sector.

Speaking at the conference, Deputy Minister of Agriculture and Environment Le Minh Ngan emphasized: Land is the main means of production, closely linked to most socio -economic, defense - security and environmental activities. Therefore, strong innovation of institutions, apparatus, processes and responsibilities in land management is always a top priority. From the 2003 Land Law to 2013, the content of decentralization to local authorities has been gradually improved. In particular, the 2024 Land Law has marked a breakthrough when strongly expanding decentralization and delegation of power to the two provincial and district levels of government. Except for some specific contents such as planning and land use plans that are still implemented by the Central Government, activities such as land allocation, land lease, change of use purpose, recovery, compensation, support, resettlement, land valuation, issuance of Land Use Right Certificates... are all transferred to localities.

Vice Chairman of the Provincial People's Committee Phan Trong Tan chaired the conference at Phu Tho bridge.

To avoid disruption in land management when converting to a two-tier local government model, the Ministry of Agriculture and Environment has issued many documents directing and urging localities to prepare human resources, databases and implementation procedures.

However, in practice, the implementation of decentralization still faces many difficulties, especially at the grassroots level - where the files are directly handled. Many places lack specialized staff, lack supporting information technology systems and are still afraid of responsibility when receiving new authority.

This training conference was organized to fully and consistently convey the contents related to decentralization, delegation of power, and assignment of authority in the land sector to the staff from the central to the communal level. At the same time, localities were able to exchange and reflect on difficulties so that the Ministry of Agriculture and Environment could have a basis to guide, promptly resolve and study additional recommendations in the process of amending and perfecting land laws, a current key task of the Ministry. The conference will contribute practically to improving the capacity of state management of land, promoting the process of decentralization and delegation of power, creating a solid legal foundation for the sustainable development of localities and the whole country.

During 1 day, delegates listened to the reporters introduce the following topics: Overview of decentralization, delegation of authority, and determination of authority in the land sector; Procedures for registration and issuance of certificates of land use rights and ownership of assets attached to land; Procedures for land allocation, land lease, and permission to change land use purposes; Procedures for land recovery, compensation, support, and resettlement; Procedures for construction and adjustment of land price lists; specific land valuation...

Delegates at the main hall and the bridge also discussed and proposed specific regulations and instructions for communes to facilitate the implementation of procedures such as: Land allocation, lease, change of land use purpose; land recovery, compensation, support, resettlement; land valuation, issuance of first land use right certificates... From there, there will be more solutions to contribute to improving the capacity of state management of land, promoting the decentralization and decentralization process, creating a solid legal foundation for sustainable development of localities and the whole country.
