The Government requires speeding up the progress of rearranging and handling houses and land at agencies, organizations and units.

On November 4, Deputy Prime Minister Ho Duc Phoc signed and issued Official Dispatch No. 207/CD-TTg on speeding up the progress of rearranging and handling houses and land at agencies, organizations and units and strengthening the management and use of houses and land of state-owned enterprises.

The dispatch clearly stated: In order to continue to accelerate the progress of rearranging and handling houses and land according to Resolution No. 74/2022/QH15 of the National Assembly , and at the same time strengthen the management, use and handling of houses and land, especially houses and land of state-owned enterprises for the right purpose and effectively, avoid loss and waste, create conditions for agencies, organizations, units and state-owned enterprises to complete legal documents on land, stabilize land rents, the Prime Minister requested Ministers, Heads of ministerial-level agencies, Government agencies, other central agencies; Chairmen of People's Committees of provinces and centrally-run cities, Chairmen of Companies/Member Councils/Boards of Directors of State-owned Corporations and Groups established by the Prime Minister to focus on resolutely implementing the following tasks and solutions:

Regarding the rearrangement and handling of houses and land, Ministers, Heads of ministerial-level agencies, Government agencies, other central agencies, Chairmen of People's Committees of provinces and centrally run cities direct agencies, organizations and units under their management to resolutely speed up the progress of rearranging and handling houses and land within the scope of rearrangement and handling according to the Government's regulations on rearranging and handling public assets such as houses and land, ensuring the completion of the rearrangement according to Resolution No. 74/2022/QH15 of the 15th National Assembly on promoting the implementation of policies and laws on practicing thrift and combating waste.

The Chairman of the Provincial People's Committee directs local authorities to promptly receive houses and land of agencies, organizations and units whose recovery plans have been approved by competent authorities, and transfer them to local management and handling in accordance with the provisions of law; avoid pushing, prolonging implementation time, causing waste; receive information, consider and resolve cases of completing legal documents on houses and land of agencies, organizations and units under local and central management in the area.

For houses and land facilities lacking Certificates of land use rights and ownership of assets attached to land, local authorities shall base on the origin, relevant legal documents and provisions of the law on land to consider and grant Certificates of land use rights and ownership of assets attached to land to agencies, organizations and units according to the provisions of law, without waiting for the rearrangement and completion of processing, causing difficulties for agencies, organizations and units in the process of completing legal documents on houses and land.

Regarding the management and use of houses and land of state-owned enterprises, ministries, branches, localities, representative agencies of state-owned enterprises and state-owned enterprises continue to fully, seriously and effectively implement the Party's viewpoints and policies, relevant State laws and Directive No. 47/CT-TTg of the Prime Minister ; focusing on the following tasks and solutions:

People's Committees at all levels direct local authorities to review and complete legal documents on land of state-owned enterprises (including equitized enterprises) in accordance with the law, ensuring the prescribed time, avoiding causing trouble and difficulties for enterprises.

Urgently receive houses and land of state-owned enterprises whose recovery plans have been approved by competent authorities, transfer them to local management and handle them according to the provisions of law; avoid pushing, prolonging implementation time, causing waste.

Resolutely reclaim land from state-owned enterprises that do not use land for the purposes assigned, leased, or recognized by the State for land use rights; lend or lease land not in accordance with regulations; allow land assigned to the State for management to be encroached or occupied; fail to put land into use or delay the progress of land use compared to the progress recorded in the investment project; fail to fulfill financial obligations to the State; reduce or no longer need to use land, and other cases as prescribed by law. Land allocation and lease must comply with the provisions of the law on land and related laws, be public, transparent, and effective.

Direct local specialized agencies on planning, land, and construction to provide guidance and provide administrative information on planning, land, and construction related to housing and land facilities for agencies, organizations, units, and enterprises to manage and handle.

The representative body of the state-owned enterprise's owner directs the state-owned enterprise to strictly comply with the provisions of the law on land, the law on management and use of state capital invested in production and business at enterprises, the law on auction, the law on equitization and other relevant laws in the management, use and handling of houses and land.

State-owned enterprises manage and use houses and land: Use land for the right purpose, within the right plot boundaries; carry out land registration declaration; fulfill financial obligations on land in accordance with the provisions of law; fully comply with procedures when exercising the rights of land users; implement measures to protect land; hand over land when the State reclaims land and other obligations of land users in accordance with the provisions of law; proactively coordinate with relevant local professional agencies to review and complete legal documents on land in accordance with the provisions of law. The legal representative of a state-owned enterprise is responsible to the State for the use of land by his/her enterprise.

Review the housing and land facilities under the management scope that have been approved by competent agencies and individuals for recovery and transfer to local management and handling according to the provisions of law; proactively contact, urge and coordinate with the Provincial People's Committee and local authorities to hand over and put houses and land into effective use, avoiding loss and waste; stop using houses and land for the purpose of renting, lending, arranging for housing, joint ventures, associations, etc. in violation of regulations; handle the responsibility of violating groups and individuals.

Competent inspection and examination agencies shall conduct inspections, promptly detect and strictly handle violations in land management and use at state-owned enterprises in accordance with the provisions of law to ensure publicity, transparency, and avoid loss, waste and negativity.

Ministries, central agencies, provincial People's Committees coordinate with agencies of the National Assembly, National Assembly delegations, People's Councils of provinces and centrally run cities, and the Vietnam Fatherland Front to supervise the compliance with laws on management and use of houses and land at state-owned enterprises to ensure compliance with legal provisions.
