Focus on removing land problems

In the context that the grassroots level is facing many challenges in land procedures, the Department of Agriculture and Environment of Da Nang city has promptly surveyed the reality, recorded and strengthened solutions to promptly serve the needs of the people.

Listening to the base

In Tam Ky ward and Ban Thach ward, many difficulties in land management according to new regulations of the 2024 Land Law and related decrees were reported by local authorities.

Specifically, the abolition of the regulation on the establishment of the first Land Registration Council under Decree 151/2025/ND-CP dated June 12, 2025 of the Government causes difficulties in confirming stable land use for records without documents under Article 137, especially in rural areas where boundaries are still complicated. The authority to grant Land Use Right Certificates after conversion of purpose is also inconsistent between the law and the decree, leading to confusion in implementation.

In Ban Thach ward, the locality is still confused, waiting for instructions on converting rural land to urban areas after administrative arrangements from old units such as Tan Thanh, Hoa Thuan and Tam Thang.

The cadastral records in this ward also lack maps according to Directive No. 299/TTg dated November 10, 1980 of the Prime Minister on land measurement, classification and registration nationwide in some locations, affecting the issuance of new Certificates for old cemetery land with administrative violations.

The representative of Ban Thach ward also requested specific instructions for approving multi-purpose land use plans for residential land combined with commercial services for existing constructions, exemption and reduction of land use fees for people with meritorious services that are difficult to verify, increasing staff for the environmental sector, and having a new mechanism to regulate support for agriculture, forestry and fisheries...

In Tra Tap commune, after applying the two-level local government model, officials had to take on a large amount of additional work but the payroll remained the same, lacking officials with expertise in land, irrigation or natural disaster prevention.

“In the past, the district level played a coordinating role among the communes in the region in terms of planning, transportation, irrigation, natural disasters, etc., but now this level no longer exists. It is difficult for the communes to effectively connect and coordinate with the region without guidance from the People's Committee and specialized departments and agencies of the city. Infrastructure is limited as Tra Tap still lacks GPS for measuring, environmental monitoring equipment, and lacks funds for waste collection,” the representative of this locality made a recommendation.

In Thang Binh commune, the problem lies in the land rental price for mineral exploitation. The land price for organizations leasing land for mineral activities was previously determined by the Quang Nam Provincial People's Committee to be 50% of the non-agricultural land price; however, through inspection and examination, the competent authority concluded that it was not in accordance with regulations. This locality is currently confused because there is no specific land price to apply to the rental price for land use rights for mineral activities for the 3 dossiers that the Commune People's Committee is receiving.

A representative of Son Cam Ha commune said that currently there is no internal process of the City People's Committee to carry out administrative procedures on land according to Decree No. 151/2025/ND-CP of the Government regulating the division of authority of local authorities at 2 levels, decentralization and decentralization in the field of land. Therefore, the settlement of records faces many difficulties, especially in the step of transferring information on financial obligations for land users...

These shortcomings not only slow down the progress of administrative procedures, but also directly affect the rights of people and businesses, and need to be urgently resolved.

Strengthening staff for the base

In response to feedback from the grassroots, the Department of Agriculture and Environment has proactively listened and requested specialized agencies to respond and provide specific advice on solutions to the problems of each locality at a recent meeting.

Mr. Pham Nam Son, Director of the Department of Agriculture and Environment emphasized: “The most important thing is to discuss practical difficulties. The Department of Agriculture and Environment has also invited representatives of the Department of Planning and Land Allocation under the Department of Land Management (Ministry of Agriculture and Environment) to directly discuss and inform about solutions to difficulties in the area. The Department of Agriculture and Environment will organize three meetings with communes and wards across the city to summarize all difficulties, find unified solutions for land and activities of the two-level government related to the agriculture and environment sectors.”

According to the leader of the Department of Agriculture and Environment, the Department is planning to increase the number of civil servants and public employees to support the two-level government. Accordingly, the increased staff will support from 1 to 3 months from the beginning of September, helping the grassroots to remove obstacles, with priority given to the land sector. Each commune will have a civil servant or public employee from the Land Registration Office to handle administrative procedures, while increasing the number of civil servants and public employees in other fields according to the proposed needs of each locality.

Strengthening civil servants and public employees at the grassroots level aims to effectively implement the Party's policies and resolutions on streamlining the organization and apparatus of the political system and contribute to building a team with sufficient qualities, capacity and prestige, equal to the tasks. At the same time, it creates conditions for civil servants and public employees to have an environment to practice, accumulate practical experience, develop comprehensively, improve the effectiveness of task performance and enhance the quality of the team at the grassroots level.

Through this team, the Department of Natural Resources and Environment will proactively grasp the situation, difficulties and obstacles of the locality in the process of operating the two-level local government to promptly support the removal and handling of problems arising at the commune and ward levels in the fields of agriculture and environment.

“The spirit is not to do things for others, but to provide guidance, focusing on land and other areas related to the environment and agriculture. We also hope that local leaders will pay attention to providing additional support for this reinforcement force,” Mr. Pham Nam Son informed.
