Additional penalties for singer Dam Vinh Hung

At a regular press conference on the afternoon of July 18, Department of Culture and Sports Ho Chi Minh City has officially responded to the incident. singer Dam Vinh Hung.

Regarding the issue of whether or not domestic performances are allowed to be performed abroad, the Department of Culture and Sports of Ho Chi Minh City responded: "Based on Point a, Clause 1, Article 2 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government , the applicable subjects are "Vietnamese organizations and individuals committing administrative violations in the field of culture and advertising in Vietnam and abroad".

Accordingly, Mr. Huynh Minh Hung (aka Dam Vinh Hung) is an individual and Vietnamese citizen who commits administrative violations in the fields of culture and advertising in Vietnam and abroad and will be handled according to regulations.

Pursuant to Point a, Clause 2, Article 1 of Decree No. 144/2020/ND-CP dated December 14, 2020, regulations on performing arts activities apply to "Vietnamese organizations and individuals performing arts activities in Vietnam and from Vietnam to foreign countries".

Therefore, performing activities according to Decree No. 144/2020/ND-CP are regulated in Vietnam's territory and Vietnamese regulations that organizations and individuals must comply with before going abroad.

The organizer who uses the performer (Mr. Huynh Minh Hung) during the suspension period will be fined from 20 million VND to 25 million VND according to Clause 4, Article 11 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government.

In addition, regarding whether singer Dam Vinh Hung is allowed to release music products on social networking platforms such as YouTube and TikTok, the Department of Culture and Sports of Ho Chi Minh City said: "Based on Clause 1, Article 2 of Decree No. 144/2020/ND-CP dated December 14, 2020, it is stipulated that: "Performing art activities are activities that create artistic products in the form of text, sound, and images to communicate directly or indirectly through technical means to the public in the form of performing arts; circulating audio and video recordings with performing art content.

And Clause 2, Article 2 of Decree No. 144/2020/ND-CP dated December 14, 2020 stipulates: "Art performance is an activity expressing performing arts, beauty contests, modeling or a combination of performing arts with fashion shows, cultural and sports activities".

Accordingly, all music products and performances on social networking platforms such as YouTube, TikTok... performed by Mr. Huynh Minh Hung since the effective date of Decision No. 2530/QD-XPHC are suspended, so Mr. Hung will not be allowed to release new music products on these networking platforms during the period of suspension of performance activities.
