
Ho Chi Minh City People's Committee has just issued Notice No. 241/TB-UBND approving 54 real estate business organizations to carry out pilot commercial housing projects (the list of land plots planned for pilot implementation has been approved by the Provincial People's Council).
The above land plots were approved by the People's Committee of Ho Chi Minh City to be implemented according to the mechanism prescribed in Resolution No. 171/2024/QH15 dated November 30, 2024 of the National Assembly (On pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights), Decree No. 75/2025/ND-CP dated April 1, 2025 of the Government detailing the implementation of the Resolution (mentioned above) and other relevant legal documents.
The announcement clearly states: This is the basis for real estate business organizations and relevant state agencies to take the next steps to implement commercial housing projects through agreements on receiving land use rights or having land use rights according to the provisions of the resolutions and decrees (mentioned above).

This notice takes effect from November 7, 2025, requiring relevant agencies, organizations and individuals to facilitate project implementation in accordance with the law.
According to the list, Ba Ria - Vung Tau area (before reorganization) has 48 organizations, Ho Chi Minh City area (before reorganization) has 6 organizations. The total area of pilot projects is 6,557,865.5m2, of which the area of rice land expected to change its purpose is 212,812.1m2.
Previously, the People's Council of Ho Chi Minh City passed Resolution No. 424/ND-HDND dated September 29, 2025, approving the list of 54/74 pilot land plots to implement commercial housing projects through agreements on receiving land use rights or having land use rights.

According to Resolution 171/2024/QH15 dated November 30, 2024 of the National Assembly, investors are allowed to negotiate to receive the right to use agricultural land, commercial service land or non-agricultural land that is not residential land. On that basis, the Provincial People's Committee will consider and grant licenses to real estate enterprises to receive the transfer of land use rights to implement commercial housing projects.
However, to be implemented under the pilot mechanism, the project must meet many conditions. Specifically, the project must be consistent with the land use planning, construction planning or urban planning approved by the competent authority.
In addition, the project must also be included in the local housing development program and plan, approved in accordance with legal regulations.
Notably, only projects included in the list of land plots approved by the Provincial People's Council and included in the implementation plan are eligible for pilot implementation.
