Ho Chi Minh City: What documents are commune-level civil servants authorized to certify?

Ho Chi Minh City People's Committee issued guidelines for the Chairman of the People's Committee at the commune level to authorize subordinate civil servants at the commune level to sign and certify many types of documents and contracts according to regulations.

The People's Committee of Ho Chi Minh City has just issued Document No. 2997/UBND-NCPC on guiding the Chairman of the People's Committee at the commune level to authorize civil servants at the commune level to implement Resolution No. 29/2025/NQ-HDND of the People's Council (HDND) of the city.

Accordingly, in Article 3 of Resolution No. 29/2025/NQ-HDND, there are 13 tasks and powers in the field of certification under the authority of the authorized Chairman of the People's Committee at the commune level. Therefore, the City People's Committee notes: The certification of copies from originals and signature certification (clauses 1, 2, 3, 4, 5, 13, Article 13) must be based on the needs of individuals, organizations and local practices. The Chairman of the People's Committee at the commune level shall consider and decide on the authorization of one or several civil servants to perform certification.

The authentication of contracts and transactions (clauses 6, 7, 8, 9, 10, 11, 12, Article 3) is based on the situation of transferring the authority to authenticate contracts and transactions from the People's Committee at the commune level to the notary practice organization and local practice. From there, the Chairman of the People's Committee at the commune level considers and decides to authorize a civil servant at the commune level to perform when ensuring sufficient standards and conditions to perform the task (qualifications, professional capacity, expertise, experience of the civil servant; ability to connect data to review the history of notarized transactions, information to prevent transactions in the city and legal responsibilities in the process of performing the authorized tasks of the civil servant...).

According to the guidance, localities that have transferred the authority to authenticate contracts and transactions to notary organizations shall not authorize the authentication of transferred contracts and transactions.

Ho Chi Minh City People's Committee notes: Regarding Clause 14, Article 3 of Resolution No. 29/2025/NQ-HDND: This is an open-ended provision, in case the law on authentication changes, so the Chairman of the Commune People's Committee shall not authorize when no new legal provisions arise.

In addition, when issuing an authorization decision, the Chairman of the People's Committee at the commune level must follow the prescribed form, determine the authorization time limit (start, end), full name, job position of the authorizer, the authorized person, the authorized task, determine the assignment of signing on behalf of the authorization and use the seal of the People's Committee at the commune level in performing the authorized tasks and powers...

The People's Committee at the commune level must introduce the signature sample of the authorized civil servant to sign and certify and send it to the Consular Department - Ministry of Foreign Affairs , Department of Foreign Affairs, Department of Justice, Department of Home Affairs and relevant agencies and organizations before signing and certifying.

The Ho Chi Minh City People's Committee also noted that the Chairman of the Commune People's Committee must be responsible according to the law for the authorization (mentioned above). At the same time, the Commune People's Committee must regularly monitor and ensure the effective implementation of the tasks and powers authorized according to the resolution (mentioned above).

The Department of Justice, based on its functions and tasks of state management, provides professional guidance on authentication in the city; presides over and coordinates with relevant agencies to monitor and inspect implementation; receives feedback, reviews, and responds to localities when requested. If necessary, synthesizes and promptly advises the City People's Committee to consider and handle according to legal regulations.
