Ho Chi Minh City tightens management of extra teaching and learning: Expected to clearly define responsibilities

The Ho Chi Minh City Department of Education and Training has recently issued a document seeking feedback and disseminating information on the draft Decision promulgating regulations on supplementary teaching and learning in Ho Chi Minh City.

One of the most important highlights of the draft is the clear definition of the responsibilities of the People's Committees at the commune/ward level, education management agencies, and other relevant agencies, organizations, and individuals in implementing regulations on supplementary teaching and learning.

In addition, the draft also outlines regulations on the management and use of funds for organizing extracurricular tutoring; inspection, supervision, and handling of violations related to extracurricular tutoring activities in the area.

This regulation applies to tutors, students receiving tutoring; organizations and individuals organizing tutoring; and other related organizations and individuals.

The principal is responsible for managing teachers who provide extra tutoring outside of school hours.

According to the draft, the principal is fully responsible for organizing and managing extracurricular tutoring activities within the school, as well as managing their teachers when they participate in tutoring outside the school.

Specifically, the Principal must organize extracurricular teaching and learning activities within the school in accordance with the regulations in Article 5 of Circular No. 29/2024/TT-BGDĐT and other relevant legal documents.

This includes periodically reviewing students' supplementary education needs, developing plans, and reporting to competent authorities to allocate budget funds, as well as mobilizing other legitimate financial sources to support supplementary teaching and learning activities.

The principal is also responsible for managing teachers who teach at the school when they participate in extracurricular tutoring, ensuring compliance with Clause 3, Article 6 of Circular 29.

Most importantly, the principal is accountable to the direct supervisory authority for the quality and management of the funds used for organizing extracurricular tutoring within the school.

In addition, the Principal is also responsible for receiving and processing feedback and suggestions from students and parents regarding tutoring, handling violations within their authority or recommending that competent authorities handle them, and periodically compiling reports on the tutoring situation at the end of each semester and at the end of the school year.

The tutoring center provides a complete list of tutors.

The draft stipulates that tutoring centers are responsible for fully complying with the regulations on tutoring and supplementary learning in Articles 6 and 14 of Circular No. 29/2024/TT-BGDĐT, as well as other relevant legal regulations.

Before commencing operations, tutoring centers must report to the local education management agencies, providing complete information on: business registration, list of tutoring classes, timetables, list of tutors (including reports from teachers currently teaching at the educational institution), tutoring fees, and tutoring plans to facilitate monitoring and inspection.

The establishment must ensure adequate facilities, comply with laws regarding working hours, overtime, and regulations on security, order, safety, environmental hygiene, and fire prevention.

In particular, tutoring centers are obligated to fully update their information on the Department of Education and Training's tutoring management software system.

Tutoring centers also need to manage and ensure the quality of tutoring, protect the rights of students and teachers, and maintain complete records of the tutoring organization for presentation during inspections.

Finally, tutoring centers are responsible for receiving and processing feedback and suggestions from students and their parents, and for providing explanations regarding the implementation of these Regulations as required by the authorities.

The People's Committee of the ward/commune is the direct manager.

For the People's Committees at the commune/ward level, instead of merely coordinating with the Department of Education and Training as stipulated in Circular 17/2012/TT-BGDĐT, they are now directly responsible for managing extracurricular tutoring activities for establishments and individuals within their jurisdiction.

Article 4 of the draft also outlines seven tasks of the People's Committee of wards/communes in managing extracurricular tutoring activities.

The draft also dedicates Articles 2 and 3 to clarifying the responsibilities of the Department of Education and Training and other relevant departments and agencies.

The draft dedicates a chapter to regulating the management and use of funds from tutoring and supplementary classes.

Matters not regulated in this Decision shall be implemented in accordance with Circular No. 29/2024/TT-BGDĐT dated December 30, 2024, of the Minister of Education and Training on supplementary teaching and learning (hereinafter referred to as Circular No. 29/2024/TT-BGDĐT).
