On October 27, the Ministry of Labor, Invalids and Social Affairs submitted to the Prime Minister a proposal for Lunar New Year and National Day holidays in 2024 for cadres, civil servants, public employees and workers of administrative agencies, public service agencies, political organizations, socio-political organizations and workers in the business sector.
On the occasion of Lunar New Year holiday 2024, for civil servants and public employees, the Ministry of Labor, Invalids and Social Affairs presents 2 options:
Option 1: Take 5 days off as prescribed, including 2 days off before Tet and 3 days off after Tet. Civil servants and public employees will take the Lunar New Year holiday in 2024 from Thursday, February 8, 2024 to Wednesday, February 14, 2024 (ie December 29, Quy Mao year to January 5, Giap Thin year).
With this plan, during the Lunar New Year holiday, civil servants and public employees will have 7 days off (including 5 days off for Lunar New Year and 2 days off in lieu of weekly days off as prescribed in Clause 3, Article 111 of the Labor Code).
Option 2: Take 5 days off as prescribed, including 1 day off before Tet and 4 days off after Tet. Civil servants and public employees will take the Lunar New Year holiday in 2024 from Friday, February 9, 2024 to Thursday, February 15, 2024 (ie December 30, Quy Mao year to January 6, Giap Thin year).
With this plan, during the Lunar New Year holiday, civil servants and public employees will have 7 days off (including 5 days off for Lunar New Year and 2 days off in lieu of weekly days off as prescribed in Clause 3, Article 111 of the Labor Code).
With the above two options, the Ministry of Labor, Invalids and Social Affairs proposed that the 2024 Lunar New Year holiday according to option 1 is 5 days off according to regulations, including 2 days off before Tet and 3 days after Tet. The Ministry of Labor, Invalids and Social Affairs stated that both options have the same number of days off, but option 1 ensures harmony between the time off before and after Tet. Option 1 was also unanimously chosen by 13/13 relevant ministries and agencies.
For the 2024 National Day holiday , the Ministry of Labor, Invalids and Social Affairs submitted two options to the Prime Minister .
Option 1: Take 2 days off as prescribed, including September 2nd and 1 day immediately after September 2nd.
Civil servants and public employees will have a day off from Saturday, August 31, 2024 to Tuesday, September 3, 2024. With this plan, on the occasion of the National Day holiday in 2024, civil servants and public employees will have 4 days off (including 2 days off for National Day and 2 days off every week).
Option 2: Take 2 days off as prescribed, including September 2nd and 1 day immediately before September 2nd.
Civil servants and public employees will have 4 consecutive days off from Saturday, August 31, 2024 to Tuesday, September 3, 2024. With this plan, on the occasion of the National Day holiday in 2024, civil servants and public employees will have 4 days off (including 2 National Day holidays, 1 weekly day off and 1 compensatory day off for the weekly day off as prescribed in Clause 3, Article 111 of the Labor Code).
With two proposed options, the Ministry of Labor, Invalids and Social Affairs proposed that the 2024 National Day holiday according to option 1 is to have 2 days off according to regulations, including September 2 of the Gregorian calendar and 1 day immediately after September 2.
The Ministry of Labor, Invalids and Social Affairs believes that both options will have 4 consecutive days off from Saturday, August 31, 2024 to Tuesday, September 3, 2024, but option 1 has the advantage of reducing administrative procedures and not having to arrange compensatory weekly days off as prescribed in Clause 3, Article 111 of the Labor Code. Option 1 is also agreed upon by all relevant ministries and agencies.
For employees in the enterprise sector, the Ministry of Labor, Invalids and Social Affairs requires employers to arrange Lunar New Year and National Day holidays according to the provisions of the Labor Code. Accordingly, for the National Day holiday, employers decide to give employees 2 days off (September 2 of the Gregorian calendar and 1 day before or after).
The Ministry of Labor, War Invalids and Social Affairs encourages employers to apply the Lunar New Year holiday for employees as prescribed for civil servants and public employees. Employers must notify employees of the Lunar New Year holiday plan at least 30 days in advance.
If the weekly day off coincides with the Lunar New Year holiday or National Day holiday, the employer shall arrange a compensatory weekly day off for the employee on the next working day as prescribed in Clause 3, Article 111 of the Labor Code./.
