Currently, disciplinary action against civil servants is carried out in accordance with Decree 112/2020 and Decree 71/2023.
Accordingly, the authority to discipline administrative officials is prescribed to be carried out by the head of the agency, organization or unit with the authority to appoint.
In the traditional three-level government model, the person with the authority to appoint primary school vice principals is the chairman of the district-level People's Committee.
When the district level is abolished, the authority to handle discipline will belong to the head of the agency delegated by the provincial level or delegated to manage the organization and staff of primary schools.
In the case of the incident occurring specifically at Kim Thuy Primary Boarding School for Ethnic Minorities, Kim Ngan Commune, Quang Tri Province, the authority belongs to the People's Committee of Kim Ngan Commune.
Also according to Decree 112 and 71, disciplinary measures applied to vice principals (management officials) include reprimand, warning, dismissal and forced resignation.
Forced dismissal is the highest form of discipline, only applied in one of the following cases: violation causing especially serious consequences; having been disciplined by dismissal but re-offending; being criminally prosecuted; using fake diplomas or certificates to be recruited.
The incident at Kim Thuy Primary Boarding School for Ethnic Minorities stemmed from a serious food poisoning incident that occurred on September 26, causing more than 40 boarding students of the school to be hospitalized with symptoms of nausea and stomachache.

Authorities later determined the cause to be the toxin-producing Bacillus cereus bacteria in the braised pomfret dish, and discovered many violations of food safety, including the fact that the Principal (Mr. Do Van My) and the cooking staff did not have a certificate of training in food safety knowledge.
This incident has seriously damaged parents' confidence in the Board of Directors, especially Ms. D.THH, Vice Principal of the school, who is directly responsible for management.
Although the commune government had twice decided to temporarily suspend Ms. H. from work, her return to school after a period of sick leave and suspension made the parents extremely upset. In the more than 2 months since the incident, parents have come to the school 4 times to pick up their children, declaring that they would continue to let their children stay home from school as long as Ms. H. was still working at the school.
Recently, the Department of Education and Training of Quang Tri province determined that the authority to discipline individuals and organizations related to Kim Thuy school belongs to the People's Committee of Kim Ngan commune.
Meanwhile, the Kim Ngan commune government said it is coordinating with the police and the school to resolve the incident, in order to soon bring students back to school and stabilize their studies.
The commune government has also proposed that the People's Committee of Quang Tri province direct relevant agencies to soon have a final conclusion related to the poisoning case so that the locality can handle it.
Dr. Hoang Ngoc Vinh, former Director of the Department of Vocational Education, Ministry of Education and Training , commented that the disciplinary action against the Vice Principal of Kim Thuy School was somewhat delayed.
If the incident happened as described by the press, Mr. Vinh said that the commune government could completely handle the disciplinary action for the female vice principal's lack of responsibility in managing the students' meals, without needing the police's conclusion.
