I have a university degree in pedagogy in 2008, a certificate of training for the professional title of junior high school teacher grade II in 2019, have held the position of main junior high school teacher, code 15a.201 for 6 years, held the position of junior high school teacher grade II (V.07.04.11) for 8 years, have many certificates of merit, certificates of merit, and certificates of merit at district and provincial levels.
When I changed my rank, I was transferred to a new grade II junior high school teacher, code V.07.04.31, and I will be entitled to it from June 1, 2023. The competent authority where I work requires that I have sufficient evidence of my duties in Clause 1, Article 4 of Circular No. 03/2021/TT-BGDDT to be entitled to it from April 1, 2021 (the effective date of Circular No. 03/2021/TT-BGDDT).
However, due to not providing sufficient evidence of duties in Clause 1, Article 4 of Circular No. 03/2021/TT-BGDDT, I will only be entitled to benefits from June 1, 2023 (Circular No. 08/2023/TT-BGDDT takes effect). The appointment of the professional title of junior high school teacher grade II (code V.07.04.31) is implemented according to the provisions at Point b, Clause 1, Article 7 of Circular No. 03/2021/TT-BGDDT, which has been amended and supplemented at Clause 8, Article 3 of Circular No. 08/2024/TT-BGDDT. Accordingly, the appointment to the professional title of junior high school teacher grade II (code V.07.04.31) for junior high school teachers grade II (code V.07.04.11) with a total time holding the professional title of junior high school teacher grade III (code V.07.04.12) and grade II (code V.07.04.11) or equivalent of 9 (nine) years or more (excluding probationary period).
Thus, the regulation on appointment from grade II (code V.07.04.11) to grade II (code V.07.04.31) only requires the time of holding the rank, not the performance of all the duties of a grade II teacher.
In addition, Clause 2, Article 5 of Circular No. 08/2023/TT-BGDDT stipulates that the tasks of teachers prescribed for each professional title rank are the tasks that teachers perform after being appointed to the rank and during the time holding the rank if assigned by the head of the public service unit. The head of the public service unit may assign teachers to perform tasks of a higher rank if the teacher is capable of performing them.
For tasks according to professional title ranks that public kindergartens and general schools are not assigned or are not qualified to perform, the heads of public kindergartens and general schools shall decide to convert them to other related tasks as a basis for evaluating the performance of teachers.
Therefore, depending on the actual tasks assigned to the school, the principal may or may not assign enough grade II tasks to teachers.
Thus, if your case meets the requirements for total time holding rank II and rank III as stated above, you will be appointed to the professional title of junior high school teacher rank II (code V.07.04.31).
