Building a legal corridor, promoting the formation and development of Vietnam data floors

On the afternoon of November 1, at the Government Headquarters, Prime Minister Pham Minh Chinh chaired a working session with the Ministry of Public Security and relevant ministries and branches on building a legal, policy and institutional corridor to promote the formation and development of a Vietnamese data platform.

Speaking at the meeting, Prime Minister Pham Minh Chinh assessed that the database plays a very important role for Vietnam; the world is also paying great attention to this issue because it is a great resource, the basis for promoting production relations, science and technology, innovation, digital transformation... which is meaningful to all economic sectors, the development, prestige and position of the country, is the driving force for growth; helps connect people with people, connect people with nature, society, and development in general.

The Government has directed the Ministry of Public Security to build National Data Center No. 1, and continue to build centers No. 2 and 3; ministries and branches must also build their own databases, connected to each other, ensuring "correctness, completeness, cleanliness, and liveness".

Therefore, we must perfect institutions, mechanisms, and policies to develop, protect, exploit, and effectively use databases; build synchronous and interconnected infrastructure; have smart governance to manage and use databases; have human resources and resources for investment.

The Prime Minister hopes that delegates will discuss this issue further, thereby connecting the databases of sectors, localities and enterprises on the basis of national database, creating an interconnected, synchronous and effective database to serve the country's development.

The Prime Minister hopes that delegates will promote their intelligence and responsibility, contribute concise, clear opinions, and go straight to the point to point out the causes, lessons learned, and propose solutions to do better in this work in the coming time.

Regarding the development orientation of data floors in Vietnam, based on the analysis of the current situation and international experience, the Ministry of Public Security proposes a number of strategic orientations to develop data floors in Vietnam:

First, perfecting the data economic model. Data economy is an economic system in which data is the resource for all economic activities related to the creation, collection, storage, processing, analysis, exploitation, sharing and commercialization of data to create added value for the economy and society. This is a new economic model in which data plays the role of core asset and main driving force of growth, data exchange plays the role of intermediary platform for data trading activities.

Second, continue to build a comprehensive legal framework for the development and management of data exchanges. It is necessary to promptly complete specific guiding documents for the implementation of the Data Law and the Law on Personal Data Protection, especially regulations on the classification, management and exploitation of public data. Build a national data valuation framework as a basis for transactions on the exchange. Supplement regulations to criminalize acts of illegal data collection, exploitation and transfer causing serious consequences.

Third, ensure data security and safety in trading floor operations. Develop regulations for protecting and controlling data on the floor with mandatory end-to-end encryption requirements, multi-factor authentication and data origin tracing mechanisms. Implement a "controlled transaction" mechanism to automatically monitor important data transactions. Establish a dedicated data incident response team and apply a post-transaction inspection mechanism to ensure the proper use of data.

Fourth, develop a public-private partnership model in the data sector. It is necessary to build a specific mechanism for investment, procurement and management of public assets in the data sector, allowing for more flexibility in public-private partnerships. Propose a breakthrough mechanism for the Center for Innovation and Data Exploitation under the National Data Center, including greater autonomy in testing new models and data products.

Fifth, strengthen human resource development and international cooperation. Strengthen specialized training in data science, artificial intelligence and cybersecurity. Promote the effectiveness of the network of Vietnamese experts and intellectuals abroad in the field of data. Actively participate in shaping frameworks, rules and governance on digital transformation and cross-border data sharing.

To effectively implement the above orientations, the Ministry of Public Security recommends to the Prime Minister a number of specific solutions as follows: assign the Ministry of Public Security to preside over the development of a policy and legal framework on data economy, data production, state management functions on data, complete the classification, management and exploitation of public data and open data; research and propose specific mechanisms and policies on public-private cooperation in developing data products and services; propose legal documents on breakthrough mechanisms in data creation and exploitation activities.

Accelerate the process of building national data infrastructure, assign the Ministry of Public Security to accelerate the completion of National Data Center No. 1; calculate the expansion of the extended Data Center at National Data Center No. 1, build National Data Centers No. 2 and No. 3, prioritize infrastructure for the National Data Platform; assign the Ministry of Public Security to preside over and coordinate with ministries, branches and localities to deploy the National Data Framework and Data Architecture at ministries, branches and localities to promote the data economy; Prioritize mastery and autonomy of core technologies and strategic data technologies, assign the Ministry of Public Security to preside over and coordinate the development of unified technical standards and regulations for a number of core technology platforms and strategic data technologies; deploy large language models, national virtual assistants, and high-performance computing centers at the National Data Center.

The Ministry of Public Security is assigned to coordinate with the Ministry of Finance to develop a national data pricing framework, including pricing criteria and methodologies for each type of data; develop a mechanism to monitor data pricing on the exchange and a mechanism to resolve disputes related to data pricing.

Assign the Ministry of Public Security to develop a policy mechanism to attract talented Vietnamese data experts from around the world to serve the development of the data economy; build an incubation project to support start-up businesses in implementing research programs, developing data products, services, solutions for developing data platforms and data economy.
